Statement of Claim
Claimant says:
"We purchased a 2008 Lincoln Navigator from this dealership in approximately February of 2016. My wife & I were assured that the vehicle was in great condition and did not have any mechanical issues; including major accidents, water damage, or anything that would impact the dependabiliity of the vehicle regarding it being a reliable method of transportation for my family. Prior to us purchasing the vehicle all of the suggested tests & carfax information was ran on the vehicle and the Cadillac dealership & their mechanics department assured us that this vehicle was in great working condition. About 1.5 weeks after we purchased it, we began to have trouble. My wife went outside one evening to run an errand & the car wouldn't start. Our insurance policy includes roadside assistance & they said this was covered so we called and they came out & started the vehicle & said to leave the vehicle running for about 15 minutes afterwards & hopefully it would start the next morning. The next morning the vehicle would not start. We called our insurance again & got it started to it could be taken to the dealership. This began a series of events where every week or so we were taking the vehicle back to the dealership because it was not running like it was supposed to. Each time they would issue a rental car while they kept the vehicle; sometimes, for 2-3 weeks at a time & each time they would call us to retrieve the vehicle; because the work was finished & it was working perfectly, & within a week we would have to take the vehicle back. We then realized that we had been sold a LEMON. A vehicle that was not working properly when we purchased it, but rather, it had been masked with a band aid to make the vehicle work decently until they sold it and got if off their lot. About 2.5 weeks in we began to check to see if there was a "Right of Reccission" on the vehicle where we could take it back due to it not running properly. We were told there was nothing we could do. Due to the age of the vehicle, at the time of purchase we bought what we thought & what was suggested, to be a pretty thorough warranty, but conveniently a number of the issues we were having were not included in the warranty. At that time we went through a world of trouble to upgrade the warranty, but all this time, we were spending money, what seemed like every week, for repairs, even with the warranty. Well, we determined that this is was obviously a transmission issue & it truly just got too expensive to shell out $$$ every week to take the vehicle to the dealer for repairs, so we are now stuck with a car that does not run properly. Unfortunately, this car was sold to us with this known issue; on the dealership end, and no one seems to care about their unscrupulous business practices and this dealership purposely selling a vehicle that does not work to a customer. There is nothing that we have done or any obstacle that we have encountered to make this vehicle stop running less than 2 weeks after it was purchased."
