Claimant's opinion: jamie doesw not understand it is very disturbing to get threatening letters when I do not owe any taxes. and to see that huge amount and not owe any taxes. She only responded when I said she must know my sales from our city of Larkspur tax payments each week. She said she could not "bill" me because she could not know these numbers. false numbers.
Because of this tax agent's threatening letter of July 28, 2019 she delivered by hand to my booth gal the management at Colorado Ren Fest has refused my payment for next year's contract they already offered me and my booth gal thinks I am a delinquent tax-payer, which I am not, and she is threatening to quit. This is defamation and abuse. I am suffering personally because of Jamie Nicolelli's lies on that letter using faked tax-due numbers, and will suffer financially for years to come if the 2020 CRF contract is not honored.
In her threatening letter of July 28, 2019 , she says we must pay delinquent taxes next week or they will start "legal proceedings" and it states some big numbers, which are a lie, as she says in a later email when I asked, she "cant know my sales"... so I sent them a check with a form for LAST MONTH'S taxes, and they returned it this last Monday (Aug 19, 2019) with some forms that do NOT have ANY TAX RATES ON THERE. NOT stating tax rates is unusual and irresponsible. they insist on us using the new forms and yet there is NO TAX RATE on there? Their online filing system does not recognize my SSN.
This letter Jamie Nicolelli (JN) handed to my booth gal is offensive even if I was a delinquent tax payer, which I am not. "Defamation" is to injure a party's good reputation with smearing or false information. My booth gal said this was "Mob-like treatment" and the interaction with the tax agent " 10minutes before opening! That left me shaky but I made a good day anyway ". Then after Jim Paradise refused our payments for 2020 contract, my booth gal said Jim told her "the office wont accept payment until he talks to m you (me) personally because my complaint letter sounded "nasty" " Well, Complaints usually sound that way... especially after a letter like that. Then my booth gal wrote: "Jim probably wants to make sure I pay my taxes on time from now on." Proof of Defamy. Because she believes me now to be a delinquent tax payer.
Read her letter to me/us. It is mean and aggressive, it is terrifying. If tax agents are allowed to speak in such an awful manner to the people who conduct business in their state and PAY THEIR WAGES, why would anyone want to do business in that state? I left New York for this reason: they tried to extort $4000 of taxes I DID NOT OWE.
I just recvd 8-27, 2019 another letter from CDoR saying I havent paid 7-18 tax, when I have sent them copies of statement and cancelled check for year 2018 paid on 1-21-19, which is when their forms say its due. I think this is a case of their office being totally screwed up and not knowing what the other hand is doing. That she has to resort to being nasty and spreading bad mean information around shows she is NEW. These are states that are going digital with their sales tax and revenue. I have experience with 20 states and filing sales taxes there 40 yr period. and they ALL go thru these growing pains. they target crafts/art sales because they are paranoid and think we are hoarding cash and not paying taxes on it, and they get themselves worked up into a tizzy about. these days almost everything is digital anyway; we ALL have card machines and its 90% charges every weekend. If they want to find cash, they should look at the owners of these shows who take ONLY cash at their concession stands, and we are talking 10K at each stand each week end. Here is the horrible letter she passed around my booth at the faire in my absence...
She/they sent me a bill in the mail last week in Dec for taxes I do NOT owe because they think I did not file taxes in 2019. I did, some of it on the wrong month but I am not paying more to cover their lack of understanding. they have lost all my filings and have requested repeatedly more and more filings because I dont pay enough for them. so they made up some numbers, mailed the bill to me, and that is a federal offense, 20 years for each false bill sent in the mail. they have rescinded my tax license and Jim Paradise of colorado Ren Fest has rejected my contract for next year, so I am out of a job for June and July so I am pursuing other work venues. I dont want this solved; I want them to get jail time. The damage to my life is done.
Some of the exhibits are not at all clear, and to be honest I think the claimant should remove them, black out personal information and re-scan and re-post them.
If I understand this correctly, the whole issue is about sales tax, presumably from last year as this year's would not yet be owed. If the festival is within the City of Larkspur, then the combined state, county and city taxes to be paid on TOTAL sales are 7.9% - Larkspur: 4%, Douglas County: 1%, Colorado: 2.9%.
It looks as though the claimant had sales of $3,602 and I can't tell what the deductions are. Usually the organizer of a fair or show will give vendors all the information they need in order to stay in compliance with local fees and taxes. Was this done?
If the vendor had total sales of $3,602, then even if he had zero deductions (unlikely) the total tax owed would have been $285 and it looks as though $140 was paid. So I can't imagine how any of this could have snowballed into over $1,000.
I am just guessing here, but it sounds to me as if the agent showing up at the festival and embarrassing the vendor did not go at all well, so things have escalated. Were taxes added or raised since the last fair? Could that have been part of the confusion?
My suggestion is that both parties take very, very deep breaths and assume that all mistakes were genuinely mistakes. The vendor clearly believes that all taxes were paid and the agent clearly believes that they weren't - but I doubt that malice or theft was intended from either side.
I recommend that the claimant contact the Colorado Department of Revenue’s Citizens’ Advocate at 303-866-4622, briefly explain the situation, and ask for the person who can best help sort this out. It will likely be a supervisor. I also recommend that the Dept of Revenue remove any penalties and take any payment provably owed (in installments if it turns out to be a lot) with no further ado. These festivals are very good for tourism and taxation and it's in everyone's best interest to ensure that vendors are comfortable with selling in the state while paying their fair share.
