Statement of Claim
Claimant says:
"A few months ago, I was sold a defective 2008 BMW X3 by Bankston /AutoNation Nissan of Irving, TX. Approximately one week after I bought the BMW from Bankston /Auto Nation Nissan of Irving, TX, I noticed 4 different warning lights came on: Airbag, 4x4, brake, and seat belt lights would all come on at the same time. I called Bankston Nissan/AutoNation service department to notify them of the warning lights because the BMW came with a 90 days warranty. They advised I bring it in for check up. I took it to their service dept, they tried to fix the problem by performing some programming to remove the warning lights, after reprogramming, the warning lights went off that day. The next day, I drove the truck, and the warning lights came back on again. I called AutoNation service dept again to notify them of the warning lights. They advised I bring it back to their service dept.

On August 3rd, 2014, I took my BMW back to Bankston/AutoNation Nissan of Irving, TX. The service manager advised we take my BMW to AUTONATION CLASSIC BMW which is an affiliate of their dealership for diagnostics as their Bankston/AutoNation Nissan mechanics are not trained to service BMW cars. Bankston/AutoNation Nissan service manager drove my BMW to AutoNation Classic BMW in Dallas, TX for repairs.

A few days later, AutoNation Nissan service manager called me to notify me of their findings with my BMW, they discovered that the BMW has series of electrical/Mechanical problems ranging from Steering Angle Sensor problem, (2) Secondary Air pump defect and (3) Oil pan gasket lick, just to name a few, the BMW service department estimated it would cost approximately $5,000 for repairs.

I felt like I was misled, robbed, deceived, and above all lied to by the Sales and finance department of Bankston/AutoNation Nissan of Irving tx, during the entire process of this transaction. The finance manager told me that the extended warranty he sold to me was bumper to bumper coverage, I was charged over $4000 for the extended warranty coverage. I only found out after taking my BMW to the AutoNation Classic BMW service department that my warranty did not cover some of the sensor that was required to fix the problem. The warranty company which is also owned and operated by Nissan of North America found an excuse to deny my claim. They claimed it was an existing condition. For that reason, they refused to cover the repairs after collecting over $4000 from me for the Warranty. This company is a scam.

I’ve been trying for months now to resolve this issue with Bankston/AutoNation Nissan of Irving tx, but to no avail. I’ve ran out of options, and I’m very disappointed with this dealership with the game they are playing, I have no choice than take legal action to resolve this matter."
