Statement of Claim
Claimant says:
"In February of 2016, I was told by Fremont Merchant Network's Marketing Director, Donna Troy, that Fremont provided discount merchant services. I "invested" in 1500 leads for $14,000. I paid for this program with credit cards. Their receipts were from Rapps Technology Consulting (in Mesa, Arizona), the broker from whom they bought the leads. Fremont's sales team was to follow up on the leads in order to sell their merchant discount credit card terminals, loan and credit line services. All contracts from my leads would be posted under my ID # so that I would be credited with commissions. I was to make $500 for each merchant contract and $500 for each terminal sold. I was also to receive a 1% commission on each merchant sale from my leads using Fremont's terminals. They told me I would make 2% on all business loans and lines of credit on each contracted lead. Donna Troy told me it would take "from 1 to 2 months tops" for me to begin making commissions from merchant contracts.

I was then turned over to Steve Blake, Fremont's Campaign Manager. He was to call me every week with a progress report. There were other staff members who handled his schedule and assisted him and Donna Troy. Mr. Blake told me that I could expect to see contracts from 20 - 30% of those leads. I was given a link to my Back Office that contained a list of all the leads for my account and their status: pending, sale, or no sale. A few months passed and Mr. Blake and his sales staff could not produce any sales from the first batch of leads. He commented that this was a very unusual situation - not to acquire any sales from a batch of leads. The leads in my Back Office were not numbered. I trusted that all 1500 were there. After Mr. Blake admitted that he was unhappy with the first batch of leads and because it was taking much longer to generate merchant contracts, I decided to count the leads. To my dismay, I found there were only about half the number of leads I had paid for.

Mr. Blake bought a 2nd batch of leads to substitute for the first batch. Once again, there were only about 750 leads rather than the 1500 leads I paid for. He apologized for being 4-5 weeks late in generating merchant sales from my leads. Mr. Blake assured me that "I will get this turned around - I will get this done for you." I began to express my discontent with this business venture and with the lack of progress on merchant contract/conversions. I complained about the missing leads, and Mr. Blake said he was going to purchase 1000 more leads for my account.

Mr. Blake missed some of our phone updates but I was able to contact his staff to reschedule - until July 13. He missed that Wednesday's update. I called to reschedule and he failed to return my calls. I called and left messages with his staff who handle his calendar, and they did not return my calls. I also emailed Mr. Blake about rescheduling, but he never responded.

Based on statements made by Mr. Blake, I am not Fremont's only disgruntled agent. I am a "small player" in that I didn't pay out a lot of money for leads. Several people apparently paid a lot more than I. I am actually paying down my credit cards with my dwindling savings. At the moment, I am living on Social Security and savings. I depended on Fremont’s and Mr. Blake’s good faith and track record to provide a reliable income source for me. Unfortunately, this is not happening. I believe that a number of people, in addition to myself, could have been defrauded by this company. What can I do to get my money back?"
