Statement of Claim
Claimant says:
"On November/18/2013 I Took my car into Mathis Tire & Auto Service to get the oil changed. I called first to find how much it would cost to change the oil in my car. They give me a quote of 24.95 plus tax. I got there and was told it was 89.95 but would give me a discount with synthetic oil it would be 59.95 plus tax then I Said ok I can do that. Then I see a advertisement paper on the counter talking about a lifetime car care package 399.95 and additional 100.00 for synthetic oil. They charged 558.74 Tax and all. Paid for synthetic oil and they put regular oil in. Instead which only last for 3,000 miles instead of the 7,000 miles that was paid for. They wouldn't do the frontend alignment which was included in the car care package that was paid for. Contacted them the 11/19/13 to get a refund and just pay for what had been done to the car on 11/18/2013 They refused to give a refund and also called corporate office and they also refused to give a refund. So I called my Credit Card Co to dispute the charge. On November/25/2013 They only refunded me 407.67 which was a difference of 151.07 for a 59.95 plus tax job which would be 68.15 they owe me."

  • My name is Joseph Pupsta. I am the store manager of Mathis Tire located 1349 E Goodman Rd. as stated in the complaint.

    Mr. Burdick arrived in our store as a customer on 11/18/2013. Mr. Burdick requested a full synthetic oil change after I personally explained the different grades of oil we offered and the benefits. Mr. Burdick requested to upgrade from a regular mineral oil to a full synthetic to take advantage of the benefits. Mr. Burdick was aware of his purchase and price of 89.95 before any work was performed.

    I also explained the advantages of our Lifetime Car Care Package priced $399.95 to Mr. Burdick. It was also explained that there was an additional $ 100.00 dollar charge for synthetic oil to be included in the Car Care Package. Mr. Burdick requested to purchase the Lifetime Car Care Package for $399.95 to include a synthetic oil upgrade to the package for an additional $100.00. The total was $499.95 + tax. Mr. Burdick received a Full Synthetic oil change at that time.

    Upon Leaving, I offered to order parts and also repair a broken passenger door mirror for Mr. Burdick. Mr. Burdick requested the repair be done and planned to return for the repair in 3 days when the replacement parts arrived for the mirror.

    The next day, Mr. Burdick called the store requesting a refund for the LIfetime Car Care Package because he had over spent his budget and with the cost for the mirror replacement, he would not have enough money for the repairs requested.

    An in store credit was issued to Mr. Burdick for $399.95 and $100.00 for the synthetic upgrade. Since Mr. Burdick was not charged originally for the actual synthetic oil change due to his purchase of the Lifetime Car Care Package, He was charged 89.95 for a synthetic oil change. Mr. Burdick was notified of the correction and also notified the in store credit would leave him with a balance of $11.00 dollars for the repair of his mirror.

    Mr. Burdick failed to arrive for his Mirror replacement. He was notified and he said he was out of town and would return in 4 days with the car. After 4 days Mr. Burdick called and said he would not return for the mirror replacement.

    Mathis Tire Corporate was contacted on 11/25/2013 and a credit of $399.99 and a separate credit for $100.00 was credited to his original credit card that was used for the original transaction. That Credit card number was confirmed by phone with Mr. Burdick and the status of his expenditure was explained at that time. He was also notified to contact the store Manager if the credit failed to appear on his account within 3 days.

    Mr. Burdick was only charged for his Full Synthetic oil change, Oil Disposal fee and Sales tax.

    Mr. Burdick was only charged for services rendered and requested.

    Note: Mathis Tire was charge a 15% charge by the parts supplier for the return of Mr. Burdick's automotive parts due to them having to be special ordered.

    As store Manager of Mathis tire and personally assisting Mr. Burdick with the entire transaction, On behalf of Mathis Tire I believe his claim to be a product of Fraud and based on false evidence.

    Mr. Burdick also stated during a phone call that he had taken his vehicle to another location for repairs.

    According to Mr. Burdick's own statement, He stopped payment on his credit card for services rendered then also received a refund in the same amount.
    This would mean Mr. Burdick made a fraudulent claim with his credit card company and still owes Mathis tire and Automotive $89.95 for his synthetic oil change. He did not have a coupon to receive coupon price. He also owes, $2.25 for oil disposal fees. Mr. Burdick would also be responsible for sales tax at the local rate. In light of this fact, based on Mr. Burdick's own admission, This entire mater will be placed under review by our legal staff. A Counter suit would be a consideration.We look forward to receiving Mr. Burdick's oil sample analysis proving he received anything other than a full Synthetic oil change.

I got a total of 3 quotes and I said never mind I just want a refund. That kind of management I can just as we'll take my business elsewhere.

  • You were told the Mirror did not come with a cover piece. You were given a new quote to include the cover piece and approved the purchase. Never did you say "never mind" or " I want a refund". You also never had a coupon for a reduced price on your oil change. That is why you were charged full price after your refund for the lifetime care package. Had you actually said the things you are pretending now to have said, We would not have ordered your parts, took a loss or be here now. Much easier if you would have returned to the store with your concerns or thought to call. You were never treated with anything other than respect, courtesy and fairness. Let's do math.

    Refund of Lifetime care w Synthetic= $499.95 0+ no tax
    Your Synthetic oil change = $89.95 +tax

  • I was never told no extra parts you was playing super salesman trying to sell me something and you give me a quote on a mirror totally finished no additives or add on I had agreed on that price only.

    shop supplies(seat covers, ETC) $19.99
    Sales tax of $36.55
    Totaling a bill of = 558.74
    Refund of Lifetime care w Synthetic= $407.67+ tax
    My Synthetic oil change = $59.95 +tax

    Total $91.12 I'm in the loss

    My Credit card Company did not stop payment You had agreed upon what the credit company said and I was only refunded 407.67

  • You did not have a coupon for $59.95. Why do you think you should have gotten the coupon price? As you know Mr. Burdick, I did everything I could to help you. There was never any other intention. I am sorry you feel the way you do. Under advisement of our legal team, No further communication will be given in this format. I would suggest speaking with Ron Varner at 901-767-9054. He handled your charge back on your credit card.

  • Mr. Burdick was contacted by Phone requesting his originally used Credit card Number for the purpose of Processing a full refund. Mr. Burdick said, "he would call back". After 1 week, Mr. Burdick was again contacted to complete his full refund and Mr. Burdick refused assistance.
