Statement of Claim
Claimant says:
"Dona Young owes me for time and mileage costs involved in caring for her adult handicapped daughter that lives, in a private residence, outside Dona's home. She also promised to send me copies of all paperwork. I have multiple phone calls, emails, voice mails, and text messages to inquire about my pay. Dona Young originally said she would pay her portion of my pay within a few days. Later, she insisted that she could not pay me until she knew the exact amount the Medicaid waiver would pay. I emailed Dona Young on 3/7/14, to note that I had received the Medicaid money. I asked that she send me her portion ASAP. I again requested a copy of all papers signed/submitted to her. I have had no reply from Dona Young. I have not received her share of my pay or copies of paperwork submitted to her. I would like her part of my pay."

  • 02-21-2014 — Contacted the following agencies involved, asked them to document my concern about not being paid: Care.com (Rebecca), PCG Public Partnerships (Regina), One on One Care (Kate). Sent letter from a friend, whom is an attorney, emailed to Dona Young regarding her finanacial responsibility to pay me. Warned of my intent to go to small claims' court if needed.
  • 03-20-2014 — Contacted the following update complaint about not being paid: Care.com (Rachel); One on One Care (Kate). Plan to also contact Regina @ PCG Public Partnerships.

  • 03-20-2014 — Using internet, located small claims forms and procedure needed for filing a small claim in Fairfax, VA.
  • 03-07-2014 — Medicaid waiver check received. Email to Dona asking when I could expect her part of my pay, as well as, copies of the documents.
  • 03-17-2014 — email sent to Dona Young that I planned to purse a small claim since it had been 10 days since I received the Medicaid waiver check.
  • 01-30-2014 — Spoke with Dona Young. She said I'd missed the deadline for submitting my time sheet. That it was due today, 1/30/14. I noted that per the time sheet schedule, my hours were not due to her until the next week; I was actually sending them early. She also questioned one hour's time. I told her to remove that hour. She told me she needed a new timesheet and for it to be "simple" with no notes. I sent an email with total hours, total mileage, and lunch cost.
  • 01-29-2014 — Met Dona Young at her home to give her signed/notorized documents. She noted she would provide me copies.
  • 01-27-2014 — Met Dona Young at a local restaurant to review paperwork (medicaid waiver, tax forms, etc). She provided me with a copy of the time sheet schedule (time due, pay sent out). She noted that after she received all papers back and signed them as needed, she would provide me a copy.
  • 01-26-2014 — Met Dona Young at her home to review the job duties; drove to daughter's home and met daughter.
  • 01-31-2014 — updated time sheet sent to Dona Young, removed cost of notary fees. Added scanned receipt for lunch per her request for a receipt.
  • 01-30-2014 — time sheet sent to Dona Young by email, reminder to please send me a copies of paperwork.
  • 01-29-2014 — 3rd day of care, transportation, lunch expense
  • 01-28-2014 — 2nd day of care, transportation
  • 01-27-2014 — 1st day of care, transportation
  • 01-29-2014 — Call to Dona Young from outside her daughter's home. Told her I was locked out. I noted that caring for her daughter involved more stress that I wanted. I noted that I would work the next day-Thursday, but that would be my last day. Dona emailed me that she felt it was her fault that I had difficulty; I had no training and started immediately. She noted that she had the next day covered and I did not need to report to work.
