Statement of Claim
Claimant says:
"Hi my name is Lianna. On December 8, 2011, I dropped off my 1997 Honda CRV to Cottman Transmission located at 501 E. Sugar Creek Rd. Charlotte North Carolina. I asked them to check it because it was hesitating to get into my driveway which is on an incline. I would have to reverse and try repeatedly sometimes to get it up in my driveway. I told them what the car was doing and asked them to check if it was my transmission, since I was going to visit my mother in NJ on 12/21/11, and didn't want any trouble while traveling. They confirmed for me that it was the transmission and it would have to be rebuilt. They gave me the repair estimate and I asked about the repair time and was told it would be ready by 12/13/11 if I gave them my credit card information along with the last four digits of my ss#. that day, which I did. I did not get my car back till 12/27/11 and had to take it back the next day, and at least 6 or more times, each time they had to keep it 2 days or more. The last time I took the car in to them was around 4/16/12 and the car was still refusing to go up in my driveway. I had my daughter video tape it on my phone. I showed it to Aurie Kaplan the very next day, since the owner was on the phone and could not talk to me. He said he would speak to the owner since I told him I don't want them to try and fix my car anymore, I just wanted my money back. Everyone at this point that worked on my transmission were just regular mechanics because the transmission person had quit from 12/9/11, but had already pulled my car down per Paula Davis the owner. I called several times to speak with the owner between 4/17/12 & 4/20/12. I told Aurie Kaplan at this point since the owner would not speak to me that I was going to report them to the BBB, and take them to court. To this day my car is not running properly, and now slams into gear which it was not doing before. I would like to get my money back to have my car repaired at Honda authorized location. I have documented every interaction day, time, person I spoke with, what was said and done. I was written up for lateness' because of the uncaring attitude Cottman Transmission showed me during this ordeal. I want to be given justice in this matter and feel that I am entitled to my money back. I paid them over $1,800 plus spent $120.00 to have my transmission checked by 3 other transmission repair shops including another Cottman Transmission location, Honda Dealership, and an authorized Honda repair shop. All three diagnosed my car with transmission problem stating that the transmission would have to be rebuilt. These diagnosis were done in February 2012.
My car currently needs new tires and I'm unable to have them replaced because I don't know when the transmission is going to give out and I will be forced to buy another car. I am hoping you will be able to help me get satisfaction in this matter. Please I need your help."

  • Lianna, I wasn't here in April when you came by Until I saw this notice I had no idea you were having problems. Ari did not tell me you came by, which is one of the reasons he is no longer here, he tried to act like he owned the place. I have a very good builder, John, who is very good with transmissions and very compassionate with people's problems. Please bring your car by and at least let him see what is going on, I promise, he will be able to help you.Thank you, Paula

  • I just want my money back you are very rude and I don't want to deal with your company anymore. As far as promising me my car will be repaired this time and having a good builder, you have told me that repeatedly, and my car is still not fixed. Ms. Paula you were there when I came in, in your office on the phone. I made sure you saw me but you never got off the phone. Ari was the only person that showed me any respect or seem to want to resolve our issue, even though he wasn't very responsive once I began requesting my money back again.
    Ms. Paula you are very rude and I don't want to deal with your company anymore. I would like to be given a refund so I can get my car fixed somewhere else and put this horrible experience behind me.

  • I think you are wrong. I have never been rude to you, if I was here, I did not see you, and like I said, I did not know you were having problems. If that was in April and this is almost the end of august, why did you wait so long in the interim? It is true you have been here sveral times, and several times i put one of my mechanics in the car with you only to have them come back and say they could not get the car to act up. I went as far as to put in a whole brand new transmission after you told me about the three places that told you that you needed a transmision. That's one reason I can not believe you are still having problems. How is that possible? It is not your old transmission, it is a new one. How cn you have the same problems with a different transision.? If you want your money back, I will need that transmission back so I can take it back and get my money back in order to pay you.

  • Just wnted to add that, my father-in-law fell and broke his hip in April and had to have surgery, my husband and I were with him until I returned on April 23, I had no knowlege of your probms. where have you been since april?

  • Three-Year Statute
    The statute of limitations that generally applies to filing lawsuits in North Carolina is the three-year statute set forth in Section 1-52 in the General Statutes. Subsection (1) states that this limitation period applies to "a contract, obligation or liability arising out of a contract, express or implied." This includes both written and oral contracts, as well as open-ended accounts involving a credit card or charge card. Once the contract is breached, a lawsuit to enforce it must be filed within three years from the date of breach or it will be barred.
