Statement of Claim
Claimant says:
"My Brother bought 2 NEW HD-2805 Ultra G3 HDTV Antennas from Joseph Butcher, Cheifland, Florida 352-210-6931, costing $100 each = $200. He was paid with 2 $100 dollar bills and said only sale he had made that day (May19, 2012). He has the money posted on his facebook proudly exploiting his sale. Agreement was to install mine on my 50ft antenna. He has a business card stating installs Direct TV with his number and his bosses number 386-344-2957. He also left message on my majic jack voice mail calling his business Satellite Monsters. After talking to Direct TV, they said he does not appear to be associated with them simply because the card says NO CREDIT CARD REQUIRED. Direct Tv always requires a credit card. After getting home, realized we didn't get a receipt. The Lava Antenna has a 2 year warranty with a receipt. He refused to give one to back up the warranty or signs of even selling the products. Approx. 5 years ago I had Dish installed and while doing so, I paid $100 to run cables up through the attic and down the walls, install directly to 2 bedrooms and then install into gray box to keep from getting wet. The antenna cables were labeled all but 1, because I had unhooked my daughters to use her converter box on my old tv while she wasn't here. I told him to use the dish cables, so I could later invest in fixing the router, etc. on the 50ft antenna and that I had paid Dish extra to install these cables. While I was pulling out the piano and arranging for him to use the Dish cables, he was outside CUTTING ALL the CABLES off except for 1. He cut them very short where they blended altogether away from the gray storage box. All he had to do is unscrew them from the box, select which ones he wanted to use, which I said the DISH ones and hook it up as Dish did my antenna and /or cable for 3 TV's. There was a TOGGLE Switch in my daughters bedroom, since there were only 2 TV HOOKUPS on the booster and/or Lava antenna and I have 3 TV'S. ALL THIS WAS AVAILABLE TO HIM. DISH used a Toggle switch to avoid running cable on the floor for the 3rd tv for the antenna and Dish satellite. HE CUT 5 places leaving me nothing but ONE Cable running into the attic to use. He also took the Dish Box that cables SCREW into and keeps from weather damage. He left shortly after, leaving cables running AROUND the 2 bedroom doors, over my daughters bed, and on my bedroom floor, then running into the living room. The stations didn't come in accept the couple I can get with the 50ft. antenna. I am 58 and it was hot, so I spent only time enough outside for him to say that he CUT A DISH CABLE. I didn't look at it and assumed he was honest and didn't say anything, but I probably won't get Dish again. I DID NOT realize he cut and took EVERYTHING, the cables, connectors, box, etc. I had already given him the elbow arm/satellite dish to turn in for money and a TV that he shows on FACEBOOK as selling for $40.00. He said he usually charges installation and didn't so that's why I did that. After researching they have sells for 2 for $100 Lava Antenna such as mine, so he still was charging approx. double the price. My daughter came back a couple days later, looked and said, "Do you know he cut about all your cables and that is why they are on the floor, bed etc. hooked up"? I called him very upset, asked for a receipt to cover the warranty, and why did he cut the cables, take them and the protector box? He said he didn't do anything and People don't get receipts nor does he like receipts. I said the antenna wasn't turning sometimes and he then accused me of breaking it which all I had done is push the red button to try to get channels in which he told me to do. He said he was going to take the cable through the walls of the living room to the bedroom. This is what I paid DISH for to avoid cable on the floor and holes in the walls. I then called and left a message not to come back and that he had done enough damage. I then called HIS BOSS at 386-344-2957. He said he was Joseph Butchers' boss and he was from LAKE CITY, FLORIDA . This was the other number on the Direct TV Business Card. I explained, as he seemed very upset and said he would fix the cables, return the box and fix what Joseph Butcher had damaged. He said he would call me back in 1/2 hour. NEVER DID. I called again the next day, wouldn't respond. I then waited 2 days and called from my friends cell phone. He answered and said he would be by to fix things early the next morning, took my address, name, etc. He never showed up. I haven't any address, but they do acknowledge that they are a business. Direct TV said they NEVER have any of their contractors advertise "NO CREDIT CARD REQUIRED" and feel this may be fraud. I also call Lava antenna's email any info I have, but they can't refund, cover the warranty without a copy of the receipt. All selling on the internet have a 60 day money back with the 2 year warranty through the Lava Co. that they back up. Direct TV wants me to send a copy of Joseph Butcher's Facebook information advertising Lava, sat, etc. and a copy of the business card with the phone numbers to investigate, but they can't repair anything because I don't have an account with them. I have not gotten an estimate on rerunning the cable properly, but I would say it will be well over the $100 I spent before. It was lower then, because he was also running Dish Sat. cable at the same time through the attic and bedrooms. I hope you can do something because sadly my brother and I were just not thinking of mistrust/scam and more of getting together and spending time together since Mama died."
