Statement of Claim
Claimant says:
"At the first meeting with Advance Solar Construction, I made it clear I
needed to save money on my electric bill (and was not interested in the
environment). Their agent L.J. Obenauer and another person who said he
worked for Advance Solar understood my position. Before anything was
ever signed,(nothing was ever signed until after several meetings) they reviewed my electric bills($600-over $700 per month)
and said their solar system would provide more than I needed and FPL
would buy the excess. They, after a short discussion started by me
about their deal seemed to good to be true, repeated more than once that
all my wife and I would be paying was about $240 or so per month for
12 years to pay for the instillation. The loan was at 2.99%. I am 79 years
old and my wife is 75. Neither of us have any knowledge about solar
energy. They said their company was A plus with the better business
bureau. I later got an email their company was well rated sent to me by
Advance Solar.
L.J. Obenauer came to my house several times and at every
meeting he essentially repeated what he had said in the beginning
because I always would bring the matter to his attention. The other man
came one other time I believe and he repeated basically what they
originally said about me being able to save money. And on the financing
he said it was just another note amortized at 2.99% for 12 years. As long
as it was paid it would stay in effect. Then he emphasized no prepayment
clause. Neither he nor anyone else actually explained how Advance Solar
was hooked up to a loan servicing company(GreenSky).
L.J. Obenauer in one of the meetings filled out a one page form,
something marked as a contract, but which he referred to as some paper
for the office, it appeared to be for some kind of battery instillation
for $19,400, handed it to me to sign. I refused to sign it and told him
FPL was enough back up. I kept the unsigned document.(I tried But was unable to attach a copy to this form. Anyway, I'd rather show it to you in person) THEN UNBEKNOWN TO
ME, HE CAME BACK AND HAD MY WIFE SIGN A SIMILAR DOCUMENT in my absence,
BUT SHE WAS NEVER GIVEN A COPY. Neither of us knew anything
about this until I got the company to fax me all the so-called contracts
after we began receiving statements and my accountant was trying to
figure out my taxes.
L.J. Obenauer repeatedly told me I would receive one bill to pay for the
instillation and I expected that bill to be what ever portion GreenSky
had coming since they had approved me up to $40,000. That turned out to
be$341.10 per month to pay off $40,000. Instead I,m paying that and
another bill to GreenSky for $164.05 for the batteries my wife had no
Idea she had purported to contract for, plus $166.03 to Service Finance
Company for something that can not be read on the document. The total
is $671.18.
THE CHARGES ON all three, at best, are grossly high. In the
application for a permit to install the panels the amount of the
contract is only $24,500 not $40,000. In addition the payment of 166.03
appears to be for additional panels. They are much cheaper even with
installation than the $19,999. And the total Of $40,000 owed on the
$341.10 per month bill is no doubt padded to use up all the funds I
was approved for.
Certainly my wife and I were ripped off. Advance Solar now claims she and
I together owe nearly $80,000.
In my last electric bill I owed $405.99. after accounting for non-fuel
of $251.10.
Far from saving me money, Advance Solar has gotten me deep in debt for nothing."

  • You are NOT alone, there are hundreds of people that have been ripped off by this individual. I spoke with someone from Titusville yesterday. I hope he ends up in prison for scamming people, what a bad person he is!!
