Statement of Claim
Claimant says:
"When we purchased our home we purchased Title Insurance through Stewart Title Insurance Co.
We recently sold our home but not without a lot of undue anxiety and the closing being held up
for months because of an issue with title insurance. This hold up cost us thousands of dollars. Two weeks before closing someone claimed they had an easement across our property. Suddenly our buyer could not get Title Insurance and we stood to lose the sale. After 3 lawyers and 1 expert historian proved to us and everyone else that no such easement exists for this person we closed
but with a small hitch. On top of closing costs was another $2,750 to our lawyer to prove the title clean with no easement. We are seeking reimbursement of that $2,750. On top of that we had to put $2,500 in a separate escrow account in the event the person came back again seeking an easement right of way over the property from the new owner. That is now happening. We are seeking reimbursement of that $2,500 from the Title Insurance Company as well. They claim they owe us nothing. And so arises the age old question- Why even buy Title Insurance. Insurance is such a scam. It is all well and good if you are paying the insurance company but when it comes to them paying you; forget it! How should we proceed in our efforts to be reimbursed by Stewart Title Insurance Company in White Plains, N Y?"
