First, I am very sorry that you are in this mess after obviously trying to make a sound business investment.
Dakota Financial appears to make its money by extending very expensive credit to people with very bad credit. I don't know about this company in particular, but most such companies prey on people who have few options, and who don't read the fine print. That's why payday lenders and BuyHere/PayHere lenders make bank (as my kids say).
1) Was there a warranty on this truck? Where did you buy it? What protections are there for "used car" sales in your state? Ryder may have some obligations here but that would depend on whether they were aware of the situation and had the opportunity to remedy it. It may also depend on your contract with Dakota Financial. And again, $20,000 in repairs and the truck BLEW UP? What warranty was there on the repairs?
2) If your insurance company paid out more than you owed to Dakota Financial, you are likely entitled to the overage. It seems unlikely to me that Dakota Financial "owns" the truck; as the lender they would normally just have first dibs on the money. Think of it this way--if someone dies and their house is sold, then the mortgage company gets paid off first, and then other debtors, and finally the heirs get paid. Same with any kind of secured purchase.
Dakota Financial likely has no responsibility for repairs unless it's a very strange contract. However, the lender would not be entitled to keep more than the amount they lent you.
If your pay-off amount was almost $12,624 MORE than what you originally borrowed, even though you'd made 5-6 payments, then I'd suspect that quite a few regulators would want to take a look at Dakota Financial's business practices.
Your complaint as it's written doesn't quite make sense, but I believe that Dakota Financial should immediately provide you with an accounting of the insurance payout. Then I believe you should provide that accounting and a copy of your contract to all the financial and consumer regulators you can find, both in California and in your own state if you're not located in California.
