Statement of Claim
Claimant says:
"BuildTechz Construction is seeking the return of $31,500 paid to Brian Dilworth under a subcontract agreement for the First Metropolitan Church of Houston fence project. The work was never started, and despite repeated requests, the funds have not been returned.

On April 1, 2026, BuildTechz Construction wired $31,500 to Brian Dilworth for the First Metropolitan Church of Houston fence project under our subcontract agreement.

After receiving the funds on April 2, 2026, Brian Dilworth never began the project and has not returned the money. Instead, on April 2, 2026, the day the funds posted to his account, he changed his phone number. We later obtained his new number through the assistance of a family member who attempted to help facilitate communication between the parties.

Brian subsequently provided a screenshot of his restricted Capital One accounts showing approximately $372.16 remaining in the checking account that received the wire and $10,000 in a linked savings account. Based on those account balances, it appeared that $10,000 of the original funds had been transferred from the checking account after the wire was received. Chase Bank later advised us that its wire recall was unsuccessful because the funds were no longer in the receiving account.

Despite repeated requests, the funds have not been returned, and the contracted work was never performed by Brian Dilworth.

Our company has made multiple good-faith efforts to resolve this matter directly. Because those efforts have been unsuccessful, we are pursuing all available legal remedies while remaining willing to resolve the matter if the funds are repaid."
