Statement of Claim
Claimant says:
"I got pre-approved for a home loan on 11/10/2012. I found the Georgia Dream Home Ownership program. I contacted one of the Lenders on the list, Alyson Foy. She in turn gave me a list of realtors she worked with, and that is how I found my agent Tiffany McLaughlin . In the beginning, I believed Tiffany understood my wants, needs,and my urgency in finding a home. . On December 22 Tiffany requested I sign an exclusive buyer brokerage agreement, which expired 3/22/13.By February 15 we had put in several bids,and went on seven to eight viewings, at that time Tiffany requested a $25 gas fee. Which is in violation of our contract,that states: a $500.00 RETAINER FEE WILL BE DUE TO THE BROKER EXCEPT IN THE FOLLOWING EVENT: IN THE EVENT THE BUYER PURCHASES REAL PROPERTY IN A TRANSACTION IN WHICH THE BROKER IS PAID A COMMISSION. OTHERWISE UPON EXPIRATION UPON THIS AGREEMENT THE RETAINER FEE SHALL BE PAID TO THE BROKER TO OFFSET BROKER'S COST & COMPENSATE FOR BROKERS TIME IN PROVIDING REAL ESTATE BROKERAGE SERVICES TO THE BUYER. At this point I started putting bids on houses sight unseen, until I found the house that I purchased. During this time she became very preoccupied and acted as if her higher paying clients were more important. Along with family functions, emergencies, and multiple vacations. We were put on the back burner.During the time of the repairs she had no knowledge of what was going on and it seemed as though she made no attempt to find out, she was the only one in contact with the seller. Several weeks passed and i took it upon myself to go to the house and see the progress of the repairs. Upon arriving we discovered the dining room floor had been removed, and the kitchen counter was cracked. I pointed out to Tiffany that the report stated, that the thresholds needed to be removed or replaced, not the floor. Her response was of little concern. She replied "The floor is gone now." I asked what could be done, and she shrugged and stated "'I'll see what I can do, but I doubt if they will fix it." More time passed and Georgia Dream requested a home inspection on my behalf. When we came to the house with the inspector we discovered that the kitchen counter was in worse condition after the first inspection. Also the home inspector informed me that the upstairs bathroom floor needed to be replaced or it would fall through the ceiling. I discussed this with Tiffany, and she said that is to be expected with a house this age. I asked about replacing the floor and she stated that she would ask and get back to me, which she never did. After everyone received copies of my home inspection more repairs had to be done. Our closing date was approaching and I had to call Tiffany to set up the final walk through, which was a day before closing. On our final walk through, once again we pointed out the doors, the uncapped light switch, the loose tiles on the bathroom floor and lastly the kitchen counter that was damaged during the repair process. With the same nonchalant attitude she said, "Its an as is house, Cheryl."
She also laughed and said, "I cant believe FHA passed this house." I closed on my house 8/29/13. On 9/2/13 after taking a shower I discovered water flowing out of the wall into the dining room and leaking from the ceiling in the pantry. The next day after washing dishes the downstairs toilet began to over flow, and would do so anytime there was running water. I sent Tiffany an urgent message along with pictures to inform her of the situation. She replied a few days later, apologizing for not responding sooner,she was out of the country. She contacted Kent Miller the sailing agent, and he advised me to get a home warranty, and that the deal was closed. In my last conversation with Tiffany she stated that she spoke with her broker and since FHA passed the home there was nothing else they could do. I hired Tiffany for her expertise and experience in purchasing a home. I expected her to act and negotiate in my best interest. Instead I feel like I was being discriminated against because of my low income and the range of my loan. She failed to do what was necessary to find me a move-in ready home. After all these events i spoke with Fannie Mae and was informed that my agent was responsible for informing them of any repairs that needed to be done before the closing date. She failed to even try to negotiate on my behalf. I'm fully prepared to provide pictures and emails of what was stated."

  • AMy name is Cheryl Alexander; I am a 46 year old single mother of two. In 2010 I suffered from a brain lesion that put me in the hospital for three months. During that time I lost the ability to walk, talk, sit up, and even eat; I was put on a feeding tube while in the hospital and after my release. Being newly disabled has been a great adjustment; it involves numerous doctors’ visits and various therapies that continue to this day. In addition to becoming disabled at the end of 2011 I was diagnosed with breast cancer. In 2012 I went through chemotherapy, radiation therapy, and had breast surgery twice. To make matters worse, my living arrangements became unstable for me and my children. We were in desperate need for a new place to live. I went online a nd found The Georgia Dream Home Ownership Program, which gave a person like me a chance to own a home instead of renting. I thought Georgia Dream was the answer to my prayers. It saddens me to say it has been nothing of a dream but a nightmare. I am writing to express my disappointment and frustration with the unhealthy conditions of the house that I waited and worked so hard for. Now that I have signed my contract no one is taking responsibility for the major damages that were supposed to be repaired before my children and I moved in. According to all FHA guidelines/ HUD handbook 4150.2dd your information here

  • I have gone through a lot of pain and suffering with the move to this house , i had to have the kitchen sink and counter top replaced ,the main sewer line collapsed and needed to be replaced, I had to go for months with water issues and in October I had to go the emergency room. Ms. Mclaughlin did nothing to get the repairs done on my house. I later found out that the things I complained to her about were part of FHA guide lines. The seller said they were not informed of the complaints that I had. Ms. Mclaughlin was only concerned with getting here commission and not my best interest and needs.
