Statement of Claim
Claimant says:
"An acquaintance borrowed $800 from me to pay an attorney. The attorney in question knows I lent the individual the money. I have sent 2 Letters of Demand to her, one regular mail, one certified. The certified one just came back.

I have emails from her and at least 2 witnesses that this transpired, plus the money was sent from my paypal to her paypal. It has been over one year now."

    If you are still with in your statute of limitations for contesting through Small Claims. It would be very wise to file before you no longer have that option, if you still do. And then I would file and issue a Subpoena to the attorney(before SC date) “in question” that both “knows” and “witnessed” you lend the individual the money. Thus, making the attorney your witness. Also simultaneously issuing same subpoena for the “records” involved in the case you financially assisted in. That looks like it may be your only option; I’m surprised there is not better and more involved feedback on here. Otherwise, if none of that is an option or works you can always relieve yourself of the burden of “tax liabilities” you’ll be stuck with. By having a- 2017 Form 1099-MISC, issued to either the attorney or your acquaintance. No reason you should also have to pay taxes on $800. when tax time rolls up soon. John

    Maybe the person cannot pay you back because they could not pay an attorney on their dime in the first place. I would suggest asking for a small, good faith payment upfront (let's say $100). Then I would asked to pay $50 thereafter. Maybe as another More...

    Ms Edrie Blackwelder..... I have everything in writing. Please do me the courtesy of at least responding with a payment plan. You borrowed from me over a year ago and PROMISED to pay me back. I believed you, have it in writing, and have witnesses.
