Statement of Claim
Claimant says:
"Discount Brake & Tire of Ocala, Florida replaced the motor ($875.00 + $850.00 labor) and transmission ($400.00 + $390.00 labor) on my car in February 2012. Since I picked up my car it has been towed back in 4 times altogether (2 of which I paid for). The first time it broke down they told me the battery terminal was loose. A few days after that I couldn’t get my car to start again and they towed it in and said they couldn’t find any problem and maybe the ignition or shifter was loose and to just play with it to get into gear. Two days later I couldn’t get my car started again so they towed it in and told me told me the fuel pump and starter had to be replaced ($352.77 + 85.00 labor) as well as a Sending Unit for $11.73.

So I got the car back the following Monday and 2 days after that, driving home from work, the trans started slipping really bad. Luckily I was approaching Darren’s Automotive and the guy checked the transmission fluid and it didn’t read at all on the stick. We put 2 qts. of transmission fluid in and you could see it leaking from underneath! The guy said it was a leaking seal in the transmission and the whole transmission would have to be taken out to be repaired.

I called Discount Brake and was told by Lenny (the owner’s father) the transmission was a rebuilt one and had no warranty on it and it wasn’t their responsibility to fix it. I called Damron LTQ in Crystal River (where DB&T got my transmission) and was told DB&T was definitely responsible and they should have checked all gaskets and seals before putting it back in my car.

So, a month after bringing my car into DB&T, I was still left with a car that I couldn't drive!

Two weeks later, I finally relented and had my transmission repaired by A-1 Transmission in Ocala, FL. This cost me another $570.00! I am so angry and feel so betrayed by DB&T as I had been a loyal customer for the last 10 years and was always treated with respect, which makes it odd that they wouldn't repair the transmission. I will no longer use their services again, as well as my family, friends and co-workers."

  • First of all your car is a 1987 Mazda which is 25 years old.
    We purchased the transmission that we put in your car from LKQ who assured us that it was a reliable transmission & that we would have no trouble with it as there was nothing wrong with it.
    They charged us $400 for this USED transmission - which is the same price we charged you, without any product price increase.
    Neither LKQ nor Discount Brake & Tire "rebuilds" transmissions. If this was a REBUILT transmission, it would have cost much more than $400.
    Taking out the old seals and replacing them is done when you "rebuild" a transmission & would cost more than a "used" one.
    We never said we did not know how to "install" a transmission - we obviously installed yours - BUT, we said we do not "rebuild" transmissions.
    As to the 4 times you were towed in, DB&T paid for 2 of those towing jobs. BUT, your fuel pump & starter also had to be replaced which accounts for 2 of those tow jobs.
    Unfortunately, as is the case in most instances, USED parts are not warranted.
    DB&T prides ourselves on our good reputation. We run an honest & dependable shop & have been in business over 25 yrs & have always stood behind our work. We always go above & beyond to assure that we completely satisfy all of our customers' wants & needs.
    BUT, WE CANNOT "WARRANTY" A "USED" PART THAT IS NOT WARRANTED BY THE COMPANY THAT SOLD IT TO US!
    We put a lot of time & effort into your car, including parts & labor we did not charge you for.
    We are willing to give you back the $400 that you paid for this transmission in order to resolve this problem, NOT because we did wrong by you, BUT, because we want to resolve this matter in an amicable way.
    Enclosed is a statement for both us to sign - attesting to the fact that this monetary settlement satisfactorily concludes all of our dealings with you in regards to your 1997 Mazda & any & all repair work done to this vehicle done by Discount Brake & Tire, Inc.
    Upon signed receipt of this statement, we will forward you our check in the amount of $400.
