Statement of Claim
Claimant says:
"Advance Trim solution committed to replace the cabinet and drawer fronts so that they would match the other cabinets. Since that time, we have sent you several text messages and placed several calls. I have not received an update since we visited towards the middle of October. At that time, you verbally ensured me the work would be completed by Wednesday, November 2, 2016. I hope there is a good, logical reason to why you have decided not to be responsive to closing our business transaction since original cabinets and drawer were delivered over 120 days ago.

As you are aware, your team was working on correcting the molding and wood type on two kitchen cabinets and one drawer, providing about 10 feet of trim to go above the upper cabinets, and providing about 5 feet of trim to go along the cabinet housing the refrigerator. We sent you a letter asking for this work to be completed by Friday, December 11, 2016 to arrange a time for installation. You have continued to be not responsive."

  • For starters, this kitchen was taken from an existing house that we built the cabinets for 3 years ago. Darrell Pierce contacted me to build 2 pre-finished cabinets to match as closely as possible to the existing cabinets. These two cabinets were delivered and installed but had subtle differences in color and machine set up due to the time gap of the original cabinets being built. I tried to accommodate but was unsuccessful in finding the pattern of material that was originally used. I made another trip to his house to pick up some old doors to hopefully use the material from to rebuild the doors for him but they were to narrow to use. Darrell is also asking for additional trim pieces and crown moulding that was never part of our agreement. He has received everything that was originally agreed upon. These are subtle differences that should be expected with 3 years between the original cabinets and the 2 new ones built.

    None of your response explains why you have not been responsive to our conversation and resolution agreement in October that you had rebuilt the three cabinet pieces and your were simply waiting on your painter to stain. Since this time you have avoided our communications. Your company was selected because you all built the original cabinets that were installed a few years earlier. When you accepted the job you did share that there was risk that the color or molding would be different. While we are prepared to accept the variation in the color, the different molding is not acceptable. From the materials you picked you stated that you could build at least one of the doors. As it relates to the trim and small piece of molding, we were prepared to pay for and have you build cabinets for our library. At this point all we expect is for the molding on the three doors to be fixed, one completed from the wood we provided and return all materials you picked up. The alternative would be for you can reimburse the $540.00 paid to your company. We have been very patient and reasonable with in trying resolve this issue and have been very disappointed in you not following through on your word.

  • We would not recommend paying Advance Trim Solutions in advance of any work being fully inspected for completeness and quality.  There follow up efforts are unprofessional and not responsive.

    Eric Burill, should a professional and call Mr. Pierce to resolve this issue. He continues to be non responsive and has not returned the original materials or modified doors as Eric promised. We will begin to evaluate other legal recourse. More...
