After realizing that the frame of my truck has developed rust, I called the Toyota Nation head quarter in California. I spoke to Mr. Kevin Stillant. After giving Mr. Stillant the VIN # of my vehicle, 4 T A P M 6 2 N 4 W Z 0 7 6 3 9 7, I was assigned case # 1011031160 and instructed to take my truck to a nearby Toyota dealer. I did so on 12/6/10. Having done this, my truck failed inspection due to rust perforation on the frame, and the vehicle was deemed unsafe to drive. I was informed that they cannot fix my truck because the vehicle has a salvage title. I dealt with one Brian Peters, 101093. at LIA Toyota, 2116 Central Avenue, Schenectady, NY 12304, and telephone number: (518) 374-3700. I explained to Mr. Peters that, in my view, since the rusting of my vehicle was due to a manufacturing defect, Toyota is at fault and they should fix my vehicle frame. Mr. Peters said that Toyota will not be fixing my vehicle. We got into a robust argument during which I told him that I will be consulting a lawyer on this issue. Mr. Peter’s response was, “Toyota has an army of lawyers, and they will eat you up for breakfast”. Mr. Peters’ demeanor and tone gave me the distinct impression that I was being treated shabbily by him because I am black and appear unable to afford lawyers’ fees to get justice in this matter. In addition, it appears that Mr. Peters is incapable of understanding the English language. All I want Toyota to do is to send to me replacements for all the rusted parts for my truck and I will get it fixed at my own expense. I do not wish or want to participate in the buyback program. Mr. Kevin Stillant appears not to be aware of the statement made by Mr. Sam Butto in March, 2008: “These vehicles may not have been properly treated in the plant with the undercoating that they use,” said Sam Butto, a Toyota spokesman.
