Statement of Claim
Claimant says:
"On 2/2/2012, I bought a 2009 Hyundai Genesis from the salesman Corey Clough and dealt with the finance manager, Gary Wertman. The car had some paint issues that they were supposed to correct. I wrote the problems down and handed it to Corey, Gary and also the service advisor, Josh.
I took the car down to the Northlake dealership to have the work done on at least eight different occasions, a 45 minute travel distance each way. Sometimes the problem they could not do the work was because it was raining, I guess they paint their cars outside (???). No telephone contact from anyone to inform me of this delay which I learned about when I came to pick up the car. THey finally took the car for another extended period of time to do the work, at this time, I again gave Josh and Corey a written list of the things that needed to be fixed. I also showed Josh areas on the driver side leather seat which was worn and the floor mat. He was going to contact the manufacturer and see if it the warranty would cover replacement. When I returned to pick up the car, the front bumper was painted but the paint ran and the rest of the car was not even touched.
This is now the end of February, I had informed all contact people from the beginning of the transactions that I was leaving the country and would not be back until the end of April. When I picked up the car Josh was not there nor was Corey. My car keys were missing which I told the business manager. Amir, and also told him when I would return and what need to be done in writing again. They made an appointment for me to bring it in on April 20th which I brought it in early, Thursday afternoon, so it would be there for them to start on the first thing Friday morning. There is now a new service manager, Holly, who did not know about my missing keys but found some on the desk when Josh left and saved them. she also did not know about the driver's seat and floor mat but would look into it. Holly was to call me when the car was finished, I had to pick it up on Tuesday since I was leaving to drive back up north. I recieved no calls, when I called her, she said it was not finished but would be done the next day. I told her I was leaving and would be down to pick the car up, she said I could keep the rental; I said to drive to Maine? she then changed her mind. When I went to pick it up she gave me an Invoice that I was to take to one of the Hyundai Dealerships in my home area and they would do the work. I contacted the Bangor dealership and was informed they do not do any body work but had a firm that did their work.
I took the car to Ashmore Brother's in Ellsworth, 207-667-8515 with the invoice. John went over the car and took pictures. I mentioned that Napleton's had told me the parking lot dings on the doors could not be fixed, he said that they could fix them. I gave him the fax number to Corey for him to send them the estimate. John called me the next day and said the fax would not go through. I called Corey, no answer as usual, then called Gary who said to send it to his fax number which John did. This was Thursday and my appoint at Ashmore Brother's was for Monday morning. On Monday morning, I get to Ashmore Brother's to find out that Naperlton's never contacted him and he did not feel comfortable doing the work without an ok from them. I then tried calling Corey, Gary, and Amir, I got no answer form anyone. I left the car there and went home to start calling someone at Napelton's. I left many messages and finally got to talk to Amir who had Corey call me.
Corey now tells me that the estimate has things on it that they had not agreed to in writing and that one of the managers would have to approve of it. We got in to a heated argument when he said I was out of the country is why they did not get the work done. I told him I wanted to speak to a manager which he sid he would have one call me. This was Monday morning, this is now Wednesday afternoon and no one has called. I called Amir and yesterday and he would call me back in fifteen minutes. NO CALL. I ALSO TOLD COREY TO HAVE SOMEONE CALL ASHMORE BROTHER'S TO ANSWER ANY QUESTIONS OR CONCERNS THEY HAD ABOUT THE WORK TO BE PERFORMED AND THEIR ESTIMATE. THIS HAS NOT BEEN DONE.
I HAVE A VERY HARD TIME CONTACTING PERSONNEL AT NAPLETON'S OR AFTER LEAVING A MESSAGE HAVING ANYONE RETURN MY CALL. AMIR STILL HAS NOT CALLED ME BACK AND SEEMS TO BE NOT ANSWERING HIS PHONE OR MESSAGES.

Other problems I have had with Napleton is: they took my drivers license for a copy and I do not have it anymore. They had to give me a photocopy of the one they had. They could not give me a license plate because the orginial registration from my trade in was not sent to the state of Maine. I do not have that registration it must be in the glove compartment of the trade in. The title has been sent to the lending agency and Gray had to send me an updated 30 day plate to allow me to drive legally.""
