Statement of Claim
Claimant says:
"I own a 2008 Mazda CX-7. On Tuesday, March 12, 2013, I was driving from Pasadena to Palm Springs. About an hour into my 2 hour drive, near Redlands, CA, a box-like symbol lit up on my dash and the car started to lose power. I slowed down and began to find my way to the side of the busy freeway. I was able to make it to the shoulder of the road just as the car completely lost all power.

Please note, previous to this I had no indication of any issues with the car. I do regular maintenance on the car twice a year and have never had additional problems or notifications of needed repairs.

What should have been a pleasant drive and time in Palm Springs, turned into an extremely expensive nightmare full of frustrations and inconveniences.

When the car unexpectedly died, I was in a remote area and had the car towed to the Mazda dealership in Palm Springs, which was 50 miles away. My car insurance covered $75, I had to pay the tow truck driver and additional $200.

The Mazda Service Advisor in Palm Springs inspected my car and informed me that somehow the coolant had leaked out and that the entire motor needed to be replaced.

When I called Mazda to inquire about the warranty coverage on my car I was informed that although my car only has 58,500 miles on it (under the 60,000 mark), my warranty ran out on February 7, 2013, THIRTY DAYS ago, and would not be covered. After I persisted, the Mazda agent I spoke with agreed to open a case to have it reviewed and get back to me.

When all was said and done, Mazda agreed to pay for the actual replacement engine part, but I was responsible for labor, all other parts and expenses, etc. which came to $2497.52.

Palm Springs Motors / Mazda Service were able to find and pinpoint the cause of the breakdown. They it was a MANUFACTURER’S DEFECT: There was a leak coming from a WELDED area on the part that holds the coolant and that, as he pointed out to me, the coolant had been leaking on the transmission for quite some time, long before the warranty ran out, 30 days ago. The leak was going into another area of the engine and would not have formed a visible ‘puddle’ under the car.

I believe Mazda should reimburse me for the entire cost of this repair and the associated expenses for the following reasons:

1) The evidence on the coolant part is clear that this is a manufacturer’s DEFECT and that it occurred long before my warranty ran out. The Service Advisors at Mazda agreed that this was, in fact, a DEFECTIVE part.

2) There was never any indication of any kind that my car needed more coolant or that it was leaking coolant. Nothing on the dash indicated I should do something; nothing appeared to be leaking under the car. I had had the car serviced and fluids checked just 4 months earlier.

3) I do my part to take good care of my car. I chose to buy a Mazda because of its good reputation of reliability and customer service and had hoped that if the unexpected would happen, Mazda would be there for me.

I believe that what I am asking for is most reasonable and in line with the values MAZDA espouses. The MAZDA website states: “Mazda develops better products and provides an ownership experience that exceeds customer expectations.”

I have sent letters, photos, receipts, etc. to MAZDA Customer Service as well as President James O’Sullivan. The response I received was that they would not be providing any further compensation.

My expenses came to $2497.52 that I had to pay out of pocket for this experience that in my estimation, and the estimation of those I have consulted, Mazda should be wholly & fully responsible for:

1) $2018.32 - Mazda Service Invoice – Parts & Labor
2) $200.00 - Towing
3) $133.88 - Car Rental #1
4) $145.32 - Car Rental #2"
