Statement of Claim
Claimant says:
"On 05/18/2011 I was promised by a Clearwire rep in Alderwood Mall, Lynnwood, WA, that if I didn't like Clearwire I will be able to return the equipment and void the contract in the same day. I was charged incorrectly and I hated Clearwire (the way it worked ) so I returned the equipment one hour after -and I had them sign for receiving the equipment.The name of the person who signed for the receiving of the equipment is Michalven Permejo and is no longer with the company. They also voided the transaction.
After about one month I started receiving calls from them urging me to pay my bill. I spent several hours with them on the phone before I convinced them that the transaction was voided and the equipment returned in the same day. I had to go to a different location-in Northgate Mall created ticket #9387403. I kept receiving calls so I asked for a fax # to send the proof that I returned the equipment and someone signed for the return -so I sent several times the proof-and I also obtained the transmission verification report on 07/15/2011at9:53am, 9:55am, 9:56am, 9:57am and 9:58 am.
The calls from Clearwire stopped and I thought that the matter was resolved.
On April 27th 2012 I received a letter from NCO Financial Systems, INC. The letter was about Clearwire Wireless LLC placing me for collection with account #2556612-regarding past due balance-with current balance due of $ 74.32.
I called them immediately and told them that I did not destroy the proof that I returned the equipment and I already proved in July to this company that I already returned the equipment in the same day and I ask for a formal letter of apology from them. I was asked if I would like the letter on the mail or in an e-mail-stating that the e-mail would only take about two weeks and the letter in the mail would arrive in about 4 weeks. I told them that I prefer the faster version. I talked to one of their reps on the phone on April 27th(Victoria #137325 located in the Philippines) and she gave me ticket #10922727.
Yesterday, May 21st I went to Northgate Mall again in the hope that I will obtain other information from a real person. The rep I found there directed me to Clearwire Wireless location in Bellevue Mall 575 Bellevue Square phone # 4250646-1035 . I found Steve, the rep on duty and he connected me to the main office-who looked up my account and told me that I was still in collection and gave me a different fax # to resend the proof that the equipment was returned in the same day.
I wonder if Clearwire waited until they thought I destroyed the proofs I have and charge me more for something I should not be charged?Or was it just because they heard an accent over the phone ?"
