Claimant says:
"Armor Guard was hired to smooth out the popcorn ceiling in the living room/dining room area. The technician did not ask/remind my father that the air handling system would need to be turned off during the project. The tremendous amount of dust from the project eventually built up in the AC unit which failed at some point in late August. It was obvious from looking at the AC unit that the dust particulates were indeed the cause. The repair required the purchase of a new compressor. The amount of dust distributed to all areas of the villa is truly ridiculous - it appears that very little effort went into protecting anything prior to starting the project. I will attach a photo of the chandelier as evidence. We contacted the company owner who insisted that per their contract, bullet #7, Armor Guard is not responsible for any loss or damage - really?? The lame offer of 200$ made by the owner does not come close to satisfying our claim. We would like to be reimbursed for the entire cost of the AC repairs plus the deep cleaning that still needs to be finished."

  • Do you have a copy of the contract with that provision? Is the exact wording that they are not responsible for damage, or is the wording slightly different (for example, is the word foreseeable anywhere in there, etc.). On one hand, if there is a provision, it is a contract you signed. However, on the other hand, a contract that basically declared they are not responsible for any damage could possibly not be enforceable. In this situation, because of the amount of damage, a sit down with an attorney may help you understand your rights in regards to the contract and the damages sustained.
