"I am owner of property financed by A and M Investment Holding Co who has failed to give Credits for timely payments made for May, June and July, 2012. Said Holding Co. refuses to correct MY ACCOUNT HISTORY and currently proceeding to Foreclose on November 6, 2012 at Llano County Courthouse. I have suffered Mental Anguish Damages and actual damages for my time in efforts to resolve with no avail. I have filed actions with the Texas Attorney Office, Federal Trade Commission, Consumer Protection Center and U.S. Department of Justice,, All with no response at this time..I have very limited financial resourse and currently under going treatment of sickness."

  • First, you should request a full payment history of the terms of your loan. While you mention that you had timely payments for those particular months, had you ever fallen behind at any time before in the loan? If not, proof of timely payments and lack of default is a defense to a foreclosure action. If you had fallen behind before, it could be that they had already declared your loan to be in default. Make sure you have careful records of your payments, and reach out to company to see if there is some sort of financial workout agreement that you could reach.
