Statement of Claim
Claimant says:
"Took my lawn mower to them because the belt kept coming off if I pulled the mower backwards.$30.00 deposit required which I pd. They had my mower for 32 days, the part cost $6.46. I call, told it needed something else done, my cost would be $112.75. I said okay. I pick it up, paid a total of $170.46. Get home try to use it my self propel isn't working, I call and they say that my transmission is gone so it won't work. Before I took it to them everything was working fine, I just couldn't pull it backward. Called them and said I wanted to talk to a manager, after holding for over 20 min the girl tells me that the manager said for me to bring it in tomorrow, which is today Sat. 5/17. I take it, I get there and told I have to bring it back Monday because there is no one there on Sats. I said we need to talk about the money, I was told no need in talking about the money, nothing can be done until Monday. This information came from the owner of Western Auto. Her name is Barb. I feel they should at least give me a break with what they have charged me. I had a decent lawn mower when I dropped it off and now I have to go buy a new one. There is something wrong with this picture."

  • In reference to claim #6597358-178008,when the mower came in the belt was flying off,it would not stay running and had a bad kickback. We ordered a guide wire for the belt,which was backordered,that was the reason it took a while to complete the repair. It needed a new blade adapter and blade. The carburetor needed rebuilding to make it stay running.They also had a lot of adjusting to do yo stop the kickback,which was so severe it would throw you.When the finally got the belt to stay on and the mower to starunning,they took care of the kickback after a lot of adjusting. Now they had it running properly they discovered the transmission would only run when it was held up in the air,it did not run when it was under pressure. We also put on a used handle, the one they had would swing back and hurt you. This we did not charge for,because it was used.We were unable to determine the transmission needed replacing until we had repaired the belt,the carburetor problem,and the kickback problem. We solved the problems the mower came in for,unfortunately the transmission needs to be replaced in order to get everything working properly.We told her it needed a transmission,but she didn't want to spend anymore money.She is not entitled to a refund,because they spent a lot of time making the mower run safely. She refused to leave the mower on Saturday,which could mean her complaint is unfounded. It left here running very well.She wanted money back Saturday without the mechanics even looking at it,she needs to bring it in Monday thru Friday for them to check it if she doesn't want to leave it.The only thing we did not fix is the transmission,which she declined to fix. If there are any other problems she needs to show them to the mechanics,we cannot fix something unless you show us it is broken. Sincerely, Bob and Barbara Horvath, Western Auto

  • Reply was sent 05-21-14,Claimant would not leave mower for mechanics to check if she had any grounds for a complaint. How can we check it out if the mechanics are not able to see why she is complaining? It came in with the belt flying off,would not stay runninng, and terrible kick back,it did not do any of these things when it left here.

  • The reply from Western Auto is totally false. My lawn mower was working fine when I took it to them for a belt repair. I can't believe what they are saying in their reply. I used my mower, as long as I went forward, if I needed to go backwards I had to lift the mower up, otherwise the belt would come off. I had the self propelled, and it started with 1 pull. Western Auto saying that the mower was in such bad condition when they worked on it is not true, it is an out to out LIE. They ruined my mower, I still feel that I should get at least $100.00 back from the $170.46 I paid them, and now I have to purchase a new lawn mower. When I called to let them know the mower was having so many problems I was put on hold for about 10 minutes, the lady came back to the phone and said the reason the self propelled wasn't working was because the transmission was burned out, at this point I asked to speak with the manager, on hold again for 15 minutes, she came back on the phone and said the manger said to bring it back tomorrow. I sad okay. Well, tomorrow was a Saturday, I took my mower to Western Auto, this is when I spoke with the manager/owner, Barb. I was told by Barb, no one was there to do anything with the mower until Monday. At this point I said , "we need to talk about the bill" Barb pushed my receipt back to me and said there won't be anything done until Monday. I walked away. There were a few people in the store at the time, (poor souls) and I'm not one to make a scene. Now I'm up set, no I'm mad. Western Auto has ripped me off of not only $170.46, but a lawn mower. For example: if the self propelled transmission was broke why didn't they tell me that before I picked it up, brought it home. and started to cut me grass, opps the self propelled isn't working. There is truly something wrong with this picture. Western Auto: own up to your error and resolve this with out more hassle. I am not, and will not drop this issue until the situation is resolved. To resolve it please pay me back $100.00. I don't think that is to much to ask after what I have been through with you. My goodness you had the lawn mower 32 days. This entire matter is ridiculous.

  • IF YOU REFUSE TO BRING THE MOWER IN WHILE THE MECHANICS ARE ON DUTY, THEN CONSIDER IT CLOSED. IF WE DON'T SEE WHAT YOU ARE COMPLAINING ABOUT,WE CANNOT SOLVE THE PROBLEM,SHOW US PROOF THAT WE DID NOT DO EVERYTHING WE CHARGED YOU FOR. YOU WANT MONEY BACK BECAUSE YOUR TRANSMISSION IS WORN OUT,WE DID NOT WEAR YOUR TRANSMISSION OUT,THAT IS FROM USE. BARBARA HORVATH
