Statement of Claim
Claimant says:
"I have spoken with the Realtor company on several occassions regarding what appears to be a Septic Tank or Sewer problem over the past three months. The human waste was initially backing up in the toilet. The Realtor company told me to keep a gallon of water next to the comode and everytime we use it we needed to pour a gallon of water down the toilet. I told them this was rediculous and I hope this was a temporary solution and they need to fix the problem. They contacted a company had Davis Septic Company come out and it appeared to be working for two weeks. The Septic Tank professionals stated that their was not enough water pressure being sent through the pipes to ensure that the wastes was carried to the Septic Tank. Shortly after that, the waste was backing up out of the toilet and also in the tubs and sinks. Human wastes flooded the house. The Realtor Company told me that they were getting frustrated and they have done all they could do. I offered to assist them by researching possible solutions and inquiring about cost, labor, etc. I began searching surrounding Septic Tank companies to see if I could get some sort of inspection for resolution. I then contacted Lowes to see if I could price comodes. They told me that it would be $100.00 for two toilets with the pressure that was sufficient. I transfered the information to the Realtor company and they were not pleased. . They told me that I was free to find another place to live because they were tired of dealing with this issue and I was allowed to break my lease.. I told them that I would assist in getting the problem fixed but I would have to use my rent money and provide them with receipts. I contacted the Realtor Company and they did not attend to the problem for several days. I insisted that they put me in a hotel until they resolved the problem. They paid for one overnight and refused to pay for any more. I told them that I have a new born baby living with me and this was unsanitary and not good living conditions for my family and I. I also told them that I would be withholding the rent until the matter was dealt with. Robinson stated that she had someone come out and install two new comodes. This appeared to fix the problem temporarily for three weeks. Now the wastes is springing up around the outside of the house and the odor is horrible. I contacted the Realtor and they said I could move. I found another Realtor Company who was willing to rent an apartment to me and requested a recommendation from Robinson Realtors. After speaking with them the other Realtor contacted me and offered me the apartment based on a good recommendation from Robinson Realtor staff. When I told Robinson Realtors that I have the apartment and I would be moving they said they require a 30 day notice and it is not guarenteed that I would be getting my 1200.00 deposit back. This is obsurd!!! Either fix the problem or give me my deposit so I can find a decent place to live. This is a clear definition of a SLUMLORD! Mind you, my rent is always on time!!! I still can't use one toilet without it bubbling in the toilet and tub!!! And not to mention, The House smells like HUMAN WASTE inside and outside the house! I have done some online research and have discovered that the Landlord can fix the problem by looking at the Vent Filters, pipes, Septic Tank, etc. At any rate, They should fix the problem and stop giving me a hard time for something that is clearly their responsibility! Or just give me my money back so I can live in a safe place. I am currently in the process of consulting with an attorney and the local sherriff dept and filing a summons and complaint. It is my goal to get this problem fixed speedily or to be returned my deposit!

I would not recommend this Realtor Company to anyone because not only did they handle this unprofessionally, They should screen their Landlords when doing business because a Landlord can ruin your business if they have property that is not adequate for living conditions. Also this Realtor Company can make one feel as though you have to be subject to such discuss and injustice! My hopes is that this Company would learn how to run a business with integrity! Dont rent a house that you yourself would not live in! Also, when you know youre wrong, sometimes it pays to eat HUMBLE PIE! Your reputation as a business should be important in the community you serve.
