Statement of Claim
Claimant says:
"I purchased a vehicle from Johnny's Auto Sales around January of 2012. A 2006 Pontiac G6 and everything was fine with the car up until it was time to get it Smogged. I took it to a little shop on stockton blvd. and the technition said it should have no problem passing due to it being a fairly new car. So after the tests were ran the tests concluded that the vehicle had a 95 or older cadillac converter inside of it. I was mortified and wondered "how the heck did they smog it in the first place ".So I then went straight to the dealership and wanted answers. Johnny was out at that time so i left my phone number and he called me back later that day. I explained what happened and he said "How do I know you didn't change it?I was appalled at his accusation. I said "how did you get it smogged the first time?" He said "I didn't do anything illegal." I asked him to compensate me for the $ 68 Failed Smog test and to buy a cadillac converter that is specific for the vehicle. He then proceeded to make calls to price the part and the price finally came down far enough to satisfy his pocket book only he then bluntly said "you are going to have to pay it but its much cheaper than the first quote.I responded with a little anger and said ."So You are not going to pay for your dealerships mistakes? he said no. so i havent made a payment for 2 mo. due to him owing me a new part . what should i do and am i at fault?"

  • Johnny is a typical sales man. Only out to make a buck. He sent me to his personal smog guy to get a second opinion and even he said it was modified. I immediately went back to johnnys and told him what he said and he got upset and asked me if I showed max the original report? I responded with a yes and he said why did u do that?! Now he knows there was a problem. I said well he took a look at the form your mechanics advised me to show him. I have the whole conversation recorded on video . The proof is in the pudding. Johnnys auto sales is a low budget sales, scam tow/auction buying car dealership.I would have never of known uf it wasn't time to get the vehicle smogged.That's the reason why it is a year after. He is running a fraudulent dealership and he knows it.

  • I disagree with the explanation / grounds provided

    "We smog all our cars before we sell them, and it passed with no problem we never touched or further more replace the catilyic converter. She came a year and a half later and told me that we put this old catylic converter I told her no one replaced it if that was the case it would have not passed smog when we did it. I told her that if that's what her car needed to pass smog then I can find her one for alot cheaper that can save her some money and I found one for a reasonable price. She got mad and said that Johnny Auto Sales was responsible to pay for it. Johnny Auto Sales is not responsible for a vehicle that she bought almost two years ago. The cars are sold as is but to make my customers feel more at ease i do give 30 day warranty for engine and transmission not two years later.
