Statement of Claim
Claimant says:
"Dear Sir/Madame

This is my dilemma on or about Jan I went into 4th, 2013 Express Tire in Vista, California for a simple oil change after seven five hours I was told I needed a radiator flush because my levels were low and a set of new brakes for front and back . So I told them to go ahead they cashed me out at that point because I was told in the beginning that it was only going to take two hours at most. seven hours later we were still there I witnesses while there several other customers that came in also for just an oil change and left several hours later paying for everything from water pumps to entire radiators. It was if they were purposely finding other problems to make money no one was happy about the outcome. When we finally left I decided that Express Tire was not a place to take my car back to my suspicion was confirmed about three days I spotted a small leak of two spots I called and the guy at Express said it was problem the over flow when the fluids were refilled mine you even though the car is old I have never witnessed any leaks. We started on our way to Jacksonville, Florida right outside of El Paso, Texas the car over heated and the anti-freeze poured out of the over-flow tank we had to wait several hours for it to cool down. We started back on our way and get temp gauge stated it was getting hot again. We pulled off and had the fluids check and everything was fine. About two hours out of El Paso the temp gauge went all the way to extreme hot we pulled off and checked the radiator it was completely empty it must have leaked out while we were in route. We were stranded in the middle of nowhere with a whole bunch of abandoned and businesses with no protection we could have been killed, raped or torture-red after about an hour we decided to call AAA after the car cooled down we were sacred to drive it by the time AAA showed up it was 4:30 a.m. we were towed fifty-miles and left at some mechanic shop in a small town in Texas. Where again we were left in the middle of no where in the freezing cold snow on the waiting another fours hours until the shop open. this was the six of January. We were supposed to be in Jacksonville , Florida by the 7th so we missed our appointment. The mechanic fixed the car and told us that whomever worked on the car at Express Tire didn't bother to recheck his work because the plug at the bottom of the radiator was barely screwed in that's why it over heated he refilled the fluids checked the hoses and we were on our way again. About 100 miles into another part of Texas the temp gauge started moving over to extreme hot we were again in the middle of nowhere he had to pull off about six or seven times before we found a small town. We pulled into Auto Zone and lucky for us a mechanic worked there in broke the scenario down to us. This is what he think happen not only did they not put the plug back in properly they didn't remove the thermostat at the time they flushed the radiator so it had a lot of build up and the motor had air in it which caused the radiator to over heat he said until the air build-up subsided with-in the motor it would constantly over heat. Or we could take the thermostat out and freeze to death while we drove because we wouldn't have heat or air we choose to keep pulling off until the latter. We made it to Louisiana outside of Lake Charles when we ran out of money because of the extra days and gas spent on the road we were stranded for two days sleeping in the car in the Walmart parking lot I was able to borrow a few dollars and we made it to the Florida state line where we slept in the car at the visitor center we as able to get more money. We made it to our destination seven days later on the 14th. I called the Corporate office and told them the same story he basically, called me a liar and stated that I was the problem and didn't know what I was talking about and told me to get the problem checked out and he would go from there. He never called back and he went on vacation while I was stranded with no money and sleeping at truck stops with not a care in the world. I called the office back and someone else had my case he told me without in receipts he couldn't do anything for me he would only refund for the service render the guy at the shop didn't give me a receipt and I paid cashed after sleeping in 23 degree temperatures in the car we just wanted to be on our way. I told him since I had to use my tow because of there neglect I wanted reimbursement for that I am still trying to get a copy of the bill. I feel that they old me for that extra seven days of pain and suffering I still get a chill up my spine when I think where we slept in the harsh conditions rain, hurricane warnings, flooding and worse we could have ended in a body bag or even worse never found. My question should I file an complaint is there any resolution for me and my daughter?

  • I contacted you on several occasions when we were stranded and you left me hanging out in the middle of nowhere we had to go out of our way because the car kept overheating. All you guys could say id called back when you have proof.

  • I only went for a simple Oil Change and ended up paying to get my radiator flushed and serviced it was about ten guys in there not really working one of them could have made sure that everything was put back together right we got half way around the world before the radiator plugged completely came out I had to get towed over sixty-miles. We were stranded in the middle of nowhere just a lot of abandoned houses we could have been rapped, killed and cut up and left to die or even worse never found. The guy at Express Tire claimed that I took the plug out of the radiator no. 1 I didn't know where the plug was and no.2 . Why would I intentionally sabotage my own car when I needed to be in another state on a certain day for an interview which I missed and extra money that I spent after we were stranded. They have ignored all of my missives because they really don't care about the Customers just the money.

  • It's really sad when human nature is thrown out of the window I went to this company because someone that trusted them recommended me and they are really hurt because we didn't receive the valued Customer Service we deserved I went ion for a simple oil changed and ended up spending money I really didn't have on a radiator flushed that was not done right they didn't even take the time to take my thermostat out which also caused other problems. My daughter and I was stranded in the middle of no where no people, no cell phone reception and broke down because your people didn't do there job. What really brothers me the most that this company know they are wrong it's been six months and no one even called to make sure we were okay and made it to or destination so what it leads me to believe is that their Customer Service comes last they do not care about there customers, their well-being or safety. Let's just go this route what if due their negligence some one happened along that were killers and left us for dead, or what if some type of wild animal could gotten in the car and tore us apart, what if the motor blew out because the car kept over heating. My car and my life has gone through many changes since this incident and Express Tire doesn't even have the decency to call. I guess their Motto is Money First Customer Last"

  • I believe your story. If you really want to push this issue and get what you want, then you need to climb the corporate ladder and see about talking to the owner of the company. The owner's name is Joe Jubela and being an owner you need to care for your business, but with no customers...you have NO business. I do not believe he would let something like this go unnoticed. If he does not heed to your complaint then that would be negligent on his part and you may be able to get more than what you are asking for if you took it to an actual court case. It would help to get ALL the names of the people that helped you when you took your car in that day. I hope you get what you are asking for.
