Statement of Claim
Claimant says:
"Houston Housing Authority has failed to comply with every term of their own agreements and stipulations.

I was renting a 4 bedroom home with my (NOW) Ex-Wife and her three kids in December 2011 in Spring Texas. I filed for a Divorce from her in 2012, 2013 and finally got the divorce in 2015. I kicked them out of the house and removed them from my HUD VASH Voucher and off of the lease in 2013 and gained custody of my 2 daughters in November 27, 2013 and went to HHA to give them a copy of the judgment giving me full custody of my daughters who were 16 and 11 at the time. I also submitted school records and child support orders. In March 2014, I submitted a MOVE REQUEST, 90 days before my lease expired in June 2014 and didn't get a response for more than 100 days after and went to the move hearing. They issued me a 1 bedroom Voucher failing to add my daughters to the voucher. One Year later June 2015, they still haven't added my 2 daughters to the voucher and issued another one bedroom voucher, so I couldn't move into a one bedroom with my daughters, so i requested an informal hearing. In October 2015, Landlord filed for EVICTION for Possession and I was forced to move out of the unit before November 2, 2015. I went to HHA on November 14, 2015 to PORT OUT and they told me it would take 60 to 90 days and they issued me a voucher only adding my youngest daughter, for 2 bedroom. On the 85th day (February 9, 2016), I called to check the status and they told me that I was up for TERMINATION for the EVICTION for Possession. I contacted the Executive Director of HHA and she also said that I can not be terminated for Possession because my lease had expired and the owner wanted his property. I am considering filing a civil lawsuit against them for discrimination based on Disabilities and their failure to complete their end of the deal. I am a veteran of the US ARMY and my daughter is disabled and receives SSI. We are homeless and they are breaking all the rules of their own program guidelines!"

  • As of today, 94 days have elapsed since I requested the Port Out of Harris County, which they originally told me it can take between 60 to 90 days. I guess my next call is to the Office of Inspector General and then Federal Court. They have refused to assist even when faced with legal extremities in place, they have not budged not one bit!! I will call HUD and make a Discrimination Complaint against them if they have not honored my request by the 22nd of February 2016. If you need the number for your own complaint, HUD 800-669-9777 and Office of Inspector General is 800-347-3735.

  • My PORT OUT finally made it on February 22, 2016, sent the same day by HHA. They claimed they did not have a copy of the Order, when I gave them a copy of it each time I presented anything to them for a receipt. I was not divorced from my last wife (not the mother of my only 2 daughters) until 2015 so the court order for my kids in this divorce were the only paper available to submit, concerning adding to the composition. I was informed that the mother of the children would have to come to HHA PERSONALLY to give an oral and written statement, indicating that the kids no longer live with her, which is an unnecessary step versus a court order that only gives the mother supervised visitation, clearly indicates that she DOES NOT HAVE CUSTODY. HHA is insulting my intelligence when they tell me that I did not submit the only existing order concerning my only 2 children, listing myself as the SMC Sole Managing Conservator of my daughters as an oversight on my behalf?
    Since, I have overwhelming proof that HHA purposely deprive my family of the legal use of the HUD VASH via Court Order, plus recorded conversations with case workers,etc, that are Lawsuit Worthy incidents that I can not, as a legal personnel, allow this to go unchecked. Someone with no legal experience would be homeless right now, so the HUD VASH PROGRAM has no SAFEGUARDS IN PLACE TO PREVENT THE HOMELESSNESS OF ALL VETERANS. I rescind the last settlement offer and I am willing to settle this matter for $500,000 cash. This will save myself the time of filing a lawsuit in federal court for violation of rights granted in a court order, manipulation of HUD VASH PROGRAM by forcing me to bring my exwife in testify orally and in writing the actual resudence of the children, and filing a Discrimination Complaint with HUD and bringing all receipts indicating paperwork submitted, downloaded recorded phones call between HHA AND myself since November 2013 up until February 22, 2016 and parading each responsible party in front of a judge and jury for a much larger Discrimination lawsuit. I will use the funds to build a shelter for those people who are being discriminated against by HHA OR need a temporary residence pending PORT OUT. This will prevent anyone from being homeless even in the Portability situation. If you choose to not take this settlement then, by March 7, 2016, I will initiate a lawsuit against HHA with evidence of a settlement offer in this claim (which after this date I will consider the offer settlement rejected) and begin looking for a location for the Shelter. If I get the shelter built before trial date, then I'll dismiss this claim and/or the lawsuit. If it goes to trial, I will sue for the original 9.5miI with 3 lawyers and a smart paralegal. Would love for you to respond by March 1, 2016 and settle this before March 7, 2016. Also, look in my records since I've been in HUD VASH IN 2009 and you will see that I won all my eviction cases filed against me except for evictions for owner possession. This case is easier to prove up then the eviction cases I WON. I will become a voice and place for justice for the homeless and discriminated people who are or were a part of HHA. Now, I see what my calling is in life!!!

  • Voucher was sent back to HHA to be forwarded to the Appropriate Housing Authority 3 weeks ago and NO RESPONSE from email request, in-person and written requests, requests from US Veteran's Resource Center in Longview and Marshall Housing Authority. Request sent to Jennifer Cook (who no longer works there) so it was forwarded to Sonya Morris (smorris@housingforhouston.com) and I received this response from Portability "Please contact the Housing Authority and let them know to send the documents to Sonya Morris -smorris@housingforhouston.com or fax: 713-260-0548. Ms. Cook is no longer with our agency."

  • I'm trying to understand your complaint as I'm not familiar with Texas housing law. It sounds as if the issue arose when you essentially changed families and possibly became ineligible for rental help with a large house in between the divorce and taking custody of your daughters.

    Your eligibility fell into a crack because the Houston Housing Authority failed to add your daughters to the housing voucher in a timely manner. Is that more or less accurate? Do you have any documentation of the request to add them? That could be helpful. 

    Are you specifically entitled to housing as the parent of a disabled child, because of your status as a veteran, or because of income issues, or all of the above? Is it your older or younger daughter who is disabled daughter, and if it's the older, is she able to live alone now that she is older or does she require your help?

    Was there any particular reason given for eviction eg rowdiness, drug use, too many people in the apartment, noise complaints, etc?
