Statement of Claim
Claimant says:
"I have a contract with American Home Shield which is suppose to provide coverage for my garage door opener but they have indicated that two experts have stated that it is my garage door that needs to be fixed, maintained, or was the cause of my garage door opener's front guide arm to bend. The first technician, whom I could not be with, indicated that my garage door opener broke and bent due to improper maintenance of my garage door. I called American Home Shield (AHS) and this was the reason they were denying my claim into having my garage door fixed. I told them the garage door was almost two years old, had passed code specifications, and that I had had the door adjusted in July of last year. They sent an electrician out and he led (AHS) to believe that the spring to my garage door was improperly placed and that the garage door guide arm should have been relocated above or below the spring header board. I called the city code enforcement officer and he came over to my house, as the city had passed the installation of a hurricane resistant garage door and had reconnected to the existing opener on 3/30/10. The city approved the work on 4/19/20 as it met all expectations. On 7/12/11 I had precision Door Overhead Garage door service come out and corrected the Spring Anchor and added turns to the spring as well as sprayed and lubed the system. I have taken the monthly steps into keeping my garage door functioning properly.
When I called AHS on the 17th of July 2012, I was told by their representative that their conclusion was final regardless of any paperwork, pictures, expert opinions, or rationality. In essence the door only needs a front bracket and a new head board with concrete support screws. I have a $100.00 deductible and even offered to pay an additional $100.00 to have the work done. Apparently the representative must not have thought that I heard nor understood her as she kept repeating: "We sent two representatives out there and they both indicated it was the garage door and not the garage door openers age or malfunction but she reiterated that the company's decision was final.
I have obtained written information about the condition of my garage door as well as the cause of why the garage door opener was damaged. None of these souces has put the blame on the garage door. I have the code enforcement office who will be happy to talk to anyone regarding my permit 10-01185 confirmation 5481. as well as the progoma; company who is willing to pay for the garage door if AHS can justify their rationale as well as Overhead Garage Precision Door service has provided me with a statement indicating that it was not the garage door which caused the breakage of the arm but normal wear and tear. The system is going on 17 years of age, and as per instructions I lubricate it every time it needs to be and at a minimum of 4 - 5 times a year.
Now approximately eighteen months ago, I had used AHS for an unrelated issue as my toilet water valve was leaking. They sent a plumber who did absolutely nothing because he wanted me to hire a tile man so he/she could cut the wall tile in order for him to have access to the pipe. The problem was the valve itself. Not anything beyond the tile but the valve. I had a friend of mine buy me a new valve, teflon tape and he replaced it in fifteen minutes. I got charged $45.00 for nothing. AHS is charging me $43.35 per month for coverage and I would like to state that not only do they misrepresent their services but they also use contractors which usually takes a long period of time for them to make their service call. Since this incident I have located other home protection plans and you would be astonished at the differences between these companies and AHS. They are cheaper, co-payment is $45.00 vice $100.00 for AHS, they use local contractors and so on... Please see if my case is eligible for your company as I can not live with this mental anguish and injustice. If need be I will try to file a lawsuit, get the Iowa pr Florida Attorney General to look into this matter. I am a 100% Disabled Vet and I did not defend this country for over 21 years only to become a victim of injustice."

  • 07-27-2012 — Updating information requested. The only address I have on AHS is P O Box 849, Carroll, Ia 51401-9901. Their phone is 800-776-4663. I have contacted them after I filed with you and they literally placed me on hold for over 15 minutes, gave me the run around and then reiterated their negative decision.
