Statement of Claim
Claimant says:
"I consulted with Kevin Millet and Megan Choy from February 8 to 26, 2016 in Salt Lake City Utah. They have since relocated to Henderson NV. They are a chiropractor and a naturopath/acupuncturist- they use the title 'Dr'on their website and in all advertising concerning their treatment modality called 'TBM' or Total Body Modification.

I went for treatment to heal Fibromyalgia, Chronic Fatigue Syndrome, food sensitivities, chronic infections and adrenal fatigue. I am on disability. I paid $3000 US for less than three weeks of treatment. I also paid $2500 US for hotel and airfare. I was told by e-mail prior to my in person consultations that I should feel better quite quickly after starting care. I was told that Mr. Millet was an expert in my conditions, and had over 30 years experience in the field.

I struggled physically during my time in Salt Lake but I complied with all that was asked, coming in 5-6/week for treatments, 1-2/day. I purchased over $500 of supplements. I became very ill one day when I was there - I was vomiting most of the day and having severe menstrual cramps, which I was told later could have been their error, as they had put me on a b6 supplement that my body was not able to 'use'.

Prior to leaving Utah, they put me in touch with a local, new practitioner in Montreal (where I live) to continue care. She had less than one year's training is his treatment method when I started seeing her. Mr. Millet assured me that he and Ms. Choy would be in constant contact with her to be sure that I was progressing well.

I was told that I should be much improved and able to live a normal life within 4-6 months. I saw my local pr 1-2x/week for 9 months. I spent $500/month on supplements. My condition not only did not improve but I developed hyperthyroidism due to a high dose iodine supplement that I was told to take (by Mr. Millet) as well as Sjogren's syndrome (an autoimmune disease). Extensive yearly bloodwork has never shown these conditions, and my local MD believes they were caused by the supplements/treatments of TBM.

As part of my treatments, Mr. Millet told me to do a type of physio called traction, but I could not find a provider in my area. He also wanted me to consult with him again, but I could not afford to.

I kept in contact with Mr. Millet and Ms. Choy throughout all of my ordeal even though they were extremely hard to get a hold of. In fact, for several months- April to October 2016 I received no reply to my concerns. When Mr. Millet did reply, it was to say to defer to my local practitioner and that he would only consult with me for $900 US/ 30 min. This was absolutely impossible for me financially.

I have suffered 17 months of infections, worsening exhaustion, pain and sickness. I have had to spend thousands of dollars more out of pocket to try to resolve the issues that I have been left with since I stopped TBM at the end of November 2016. I would like a refund of $6000 for treatments, supplements and travel costs +$1000 for severe emotional distress caused by professional negligence. I was not informed, in the many e-mails prior to me consulting with Mr. Millet and Ms. Choy, that I would be required to do traction or to find someone for this type of care - which would have prevented me from consulting with them in the first place, since there is no one in Montreal, or Quebec, or even in the neighbouring province of Ontario who has this machine.

Further, I was not informed that I would be spending $500 a month on supplements, seemingly in perpetuity - this has caused tremendous financial strain for myself and my grandfather, who helped me finance my trip and treatments. When I pleaded with Mr. Millet, in one of my final e-mails to him, for help and advice because I was so sick- he told me essentially that even he, after all these years of using his own method- still takes 20 supplements a day and receives treatments by his wife almost daily - this is completely unsustanable for an average person and does not speak to a successful treatment outcome.

I did not sign up for this. I have paid dearly physically and emotionally because of his and his wife's negligeance. I am asking for a refund which is more than fair."

    If Total Body Modification made fibromyalgia etc. worse instead of improving condition, then refund is owed in my opinion. More...
