Statement of Claim
Claimant says:
"I called Mobile Tech out to look at my 42" RCA flat screen TV on Feb 2, 2012 (found them in the yellow pages). John, "owner" of company, came to my house for the call. I was told the problem and that it could not be fixed, that the part was no longer available. John then told me that he would look online to see if he could locate the part. I said "that would be great, thank you." I paid him $65 for the service call in cash. Then on Feb 9, 2012 John called me and told me that he had found a part online the price was $110.00, I said "great, go ahead and order it." He said that he would need the money up front to order the part. I said "OK". He then said that he would come by my house to pick up the payment later that evening. When he showed up, I paid him $120 in cash (hundred dollar bill and a twenty), I didn't have change and neither did he. He told me that he would bring me the change w the new part, I agreed. John told me to allow about 7-10 days for the part to come in the mail, then he would return. I said "OK, thanks". After not hearing from him I called him on Feb 23 (2 weeks later), to check the status on my part. John did not even remember my order! I have made numerous attempts to contact John and to get either the part or my money back. He is still claiming that he has "no" record of my order or the transaction. I told him that I have a hand written receipt, by him, that I could send him a copy if he would like. He is avoiding my calls, then proceeded to text me instead. Still claiming to not have my money! On April 6th, I text-ed him to ask for my money, and to please don't make me take further action. He responded, "sorry, I have had no work at all I owe u and two" that was the whole message......I tried to make contact again on June 2nd, giving him 10 days to respond or I was going to proceed w further action. Still NO response. I am sorry, but it has been over 4 months!!!!! I am on a fixed income, had to borrow the money to get the TV fixed....then had to borrow to buy another TV after this issue. I tried to be nice..but this makes me wonder ....how many others are out there that he has done this to. All I am asking for is my part money back. I have my receipts along with all of the conversations and my attempts to contact John on paper. I have saved the texts to my phone as well, til this issue is resolved."

  • 02-24-2012 — left phone message, checking on part, per Johns request
  • 02-29-2012 — talked to John, he still does not remember or have part
  • 03-01-2012 — left message for John to either find part or return my 120 dollars, its been 3 weeks!
  • 03-02-2012 — called both business and cell phone, left message to return my call
  • 03-05-2012 — called left another message for John, been over a month now, i need my money back since there is NO part
  • 03-13-2012 — called both business and cell "again", asking for a return call or my $120 back
  • 03-13-2012 — recieved a text back from John...saying that the only part he could find is $200 and that they are on back order. But i have no record of your transaction.
  • 03-13-2012 — i replied that i had a hand written reciept from you dated 2/9/12
  • 03-13-2012 — John replied ok, how much did i charge you total
  • 03-13-2012 — i replied, 120.00, with my mailing address if you want to send me a check or money order. i also told him that i could mail him a copy of the reciept if he would like
  • 04-06-2012 — i texed this is ......i still have not received the 120 from you for the missing part. please dont force me to take further action
  • 04-06-2012 — John replied: sorry, i have had no work at all i owe u and teo
  • 06-02-2012 — i texted this is ......i still have not recieved the 120 for the part. if i dont receive it within the next 10 days i will be taking further action. its been 4 months!!!!!!!
  • 06-14-2012 — still no response from John. i called BBB in Sac, CA to file a claim
