Claimant says:
"I recieved a check to hold for a loan of 4,000.00 from the company president because he said he had recieved a bad check andd there wasn't enough money to cover it. I agreed to loan him the money, he wrote me a check to hold which have done checked the bank there was money to cover it, but when I got to bank there was not any money. I have recieved 600.00 from him That is all and I need my money now. I loaned the money in April . I still have the check. The bank said not to take any more checks only cash. I talked to the authorities and they advised to go to claims court.to hire an attorney"

  • this was a favor to a friend , i am in desperate need for the money .evidently your banker and you are close friends and when i called to see if the check was good ,the banker must have called you ,it was good when i called and by the time i drove about a mile to bank the funds were gone. if you dont pay me by july 15 i will take you to court . iknow personally that you have the moneyand are using my money to operate the business if nothing else i will place a lein on some of your propertyalso driving under the influence is not legal , you can and will be caught,also an open container in the car isn't legal.iwillwork with you if you will make an effort to help me out.

  • I agree with the advice you were given - in the state of North Carolina, small claims allows for a limit of recovery of a debt of up to $5000. It is a good place for when you are owed money, and the other person or party has not responded to other avenues. Another option, before actually bringing a small claims case, would be to write to the company, indicate that you are owed money, provide any proof that you have, reference this claim (so they can address here if possible) and send it certified so you will know they have received it.
