Statement of Claim
Claimant says:
"I HAVE BEING TRYING IN VAIN TO MAKE FOR CREDIT COMPANY TO UNDERSTAND THEIR MISTAKE AT NO AVAIL. ON 10/12/ 2009- WE HAVE LEASED OF A LINCOLN MERCURY MKX AWD- ORIGINALLY WE WANTED A BLACK COLOR, BUT THE Y DO NOT HAVE ONE IN STOCK AT THE TIME. THE SALESMAN INSIST, IN US TO TAKE A WHITE ONE AND WHEN THE BLACK ARRIVE THEY WILL EXCHANGE AT THE SAME RATE. WE FINALLY ACCEPTED THE DEAL. 15,000 MILES PER YEAR WITH A PAYMENT $370.89. WITH A SUBSTANTIAL CASH TO LOWERED THE MONTHLY PAYMENTS. ON 12/23 THE SALESMAN CALL US BACK TO LET US KNOW THAT THE BLACK LINCOLN HAS ARRIVED. WE WENT TO DO THE EXCHANGE ASSUMING THAT EVERYTHING WAS GOING TO BE AS PROMISED. THE SALESMAN AND THE MANAGER TOLD US THAT THE CAR HAS ESPECIAL WHEELS AND $1,000.00. WAS TO BE PAID

CASH. WE DID WHILE THEY FILLED ALL THE DOCUMENTS. WHEN WE WERE TO SIGN, THEY INSISTED THAT EVERYTHING WAS THE SAME AND MY WIFE SIGNED THE PAPERS, IT WAS VERY LATE THAT NIGHT AND THE OFFICER IN CHARGE OF THE LEASE SEEM IN A RUSH TO LEAVE. WITH THE DOCUMENTS SIGNED WE TOOK OFF. WHILE MY WIFE DROVE I START TO LOOK ALL THE PAPERS. TO OUR AMAZEMENT, THEY HAD INCREASED THE PAYMENTS FROM : $370.89 TO $389.54 AND THE MILLAGE - FROM 15,000 TO 10.500. THE CASH THAT WE GAVE TO THEM $12,800 INCLUDING OUR OLD JEEP. WAS NOT ADDED. INSTEAD THEY GAVE US $5,000 IN REBATE .



AS WE WERE TRYING TO RETURN AND CALLED, BUT THERE WAS NOT ONE AT THE OFFICE. WE TRY IN VAIN FROM THEN ON TO UNDERSTAND AND NEVER GAVE US ANY SATISFACTION

THEN ON 11/03/2011 WE DECIDED TO GIVE UP WITH THE FORD MOTOR CO. AND WE DECIDED TO GO BACK TO THE JEEP AND WENT TO THE BROWN DAUB TO BUY THE JEEP AND DELIVERED BACK THE LINCOLN MERCURY. WE PAY $977.60 IN EXCESS OF MILEAGE AND GAVE A CHECK FOR THE FINAL PAYMENT OF $430.15. HERE IS WHEN OUR HEADACHE STARTED. THREE MONTHS AFTER WE START RECEIVING BILLS AND TREATS FROM THE FORD CREDIT DEPARTMENT AND TO REPORT TO THE CREDIT BUREAU, IF WE DO NOT SENT OVER A $1,000.00 DOLLARS DUE TO DAMAGE TO THE CAR PLUS THE $977.50 OF EXCESS OF MILEAGE.
FINALLY THE COMMERCIAL RECOVERY SYSTEM, TOOK OVER AND GAVE US A FINAL OPPORTUNITY FOR NOT TO BE REPORT TO THE CREDIT BUREAU. OF $600.00 AND IT WILL BE THE FINAL AND ONLY PAYMENT. MY WIFE WAS VERY DISTRESSED FOR ALL THESE AND SHE WANTED TO PUT AND END TO OUR MISERY AND PAID THE $600.00.
WE HAVE ALL THE DOCUMENTS TO PROVE IN ANY COURT THE HARM THAT THE DORAL LINCOLN MERCURY OF MIAMI AND THE FORD MOTOR CO. HAS INFLICTED ON OUR FAMILY."
