Statement of Claim
Claimant says:
"I had a root canal done and a crown applied. A few days later (Thursday) the crown came off. It was a holiday but I was able to reach a lady by telephone. She said my dentist was unavailable and I would need to wait until the first of the next week before I could see anyone to have it put back on. I asked for a referral to an emergency/after-hours dentist that could help me but she said there wasn't one.
The following week (Tuesday as I recall), I came in to have the crown put on. My dentist found that in the days it had been off the tissue has grown and the crown wouldn't go on. He gave me a shot to deaden the area and proceeded to burn the tissue off. I was given the end of a cable to hold onto (ground wire I assume) and he began. I could still feel pain so he gave me another injection. He waited longer than usual for it to take effect, saying he'd given me more than usual to make certain it would be numb. After a few minutes he was able to remove the tissue and put the crown on.
The numbness continued throughout the evening, but I was not concerned, assuming that it was taking longer than normal to go away because of the larger dose. When I woke up to find that it was still numb I became concerned. I waited anxiously for the office to open and called. After explaining that I was still numb from the previous day, the dentist came on the line and asked some questions.
He explained that nerve damage can occur although it is rare, and stated that another patient had a similar outcome recently. He said he wanted to talk to that man and see how he did and he would call me back.
We talked again shortly afterwards. He told me the numbness might go away within a few days although it could take up to 18-24 months, and worst case was that it could be permanent. The only way to know for sure would be to wait and see. He said unfortunately there was nothing that could be done and asked if he could check in with me from time to time to see how I was doing.
He did call me several times over the next few weeks, but I have had no contact in the 17 months or so since then. I assumed that I would be brought into the office at some point to be evaluated or have some follow up but there has been none.
For over a year and a half, my lower jaw is partially numb. I can feel pressure in the numb areas but no normal sensations. The worst part is that my tongue went from being numb in the first few days to a fierce burning sensation, very painful and never letting up. It affects about two-thirds of my tongue. The taste buds are also affected, giving me a constant metalic/blood-like taste in my mouth.
I found a new dentist and discussed it with him. He explained that the damage was likely caused by either the injection itself or the medication that was used. I had him examine the tooth that was worked on because it didn't feel right. Because of the nerve damage I could tell him specifically what hurt but something was wrong.
He referred me to an endodontist who did a 3-D scan. After consultation with my new dentist an an oral surgeon, they decided to have the endodontist repair the tooth. After two procedures, the original root canal was repaired.
I have lived with this constant pain for over a year and a half now, and am trying to come to terms with it being a permanent part of my life. I am constantly biting into my tongue which doesn't function as it used to. My speech requires constant effort to keep it from slurring but even so it is often apparent that something is wrong.
I have spent money on specialists and medications, hoping to find relief. I've also had the cost of redoing the original root canal that led to all of this. I expect to have increased medical costs for the remainder of my life due to this. The pain has affected my work performance and every aspect of my life. I can't get away from it and it often becomes hard to concentrate and function normally. I have become withdrawn and struggle with the thought of dealing with this forever."
