Statement of Claim
Claimant says:
"My name is Diane R.; I am currently a tenant in apartment 52XX and have been for almost four years. In the beginning things were okay and somewhat to my satisfaction. But as time as passed, starting from management down to the grounds’ keepers, I feel this property has significantly gone down from mediocre to extremely poor. I have been hoping for a change in the upkeep of the property since the buyout of the previous company and have yet to see any improvements.

I find it to be below subpar for the amount of money I pay monthly for rent. And my expectations were so much higher than what I’ve actually received as a good standing tenant.
I have recently had to place several maintenance requests, some of which were repeated requests due to lack of craftsmanship of the maintenance crew, I’ve had to call in the same request multiple times due to no response, the grounds are beyond filthy on a regular basis, the trash sometimes goes days without being dispensed (from the door) and when it is, it leaves such horrible residue and drippings behind that is so eye soaring and embarrassing to have guests over to see this. The trash compactor is sometimes left for days with piles of trash on the outside of the bin creating even more of a stench. The pool and grilling area is not an enjoyable place, due to the overwhelming stench and large flies that the trash attracts. And not to mention, the Café appears to never be open…. Now granted I understand that there are tenants on the property that are carefree with no regards to how they live or the environment there of, but I am not one of them and should not have to feel as those I am being penalized because the property management team shows no sense of urgency in keeping the property maintained daily. I also fault management for your lack of discretion on who you allow to become tenants. It appears as though any caliper of persons can reside as long as they can pay, I suppose…. Then there is the company’s decision to close the drop boxes, yet again another inconvenience and penalty to those like myself because of certain mindsets that are allowed to reside. ( I have to stay until you open to drop my payment off which means I am late for work). Quite frankly, the way it has been at least for the last past year is beyond unacceptable. In fact I would go so far as to say that you could not possibly live on this property yourself; for if you did, you would find that my concerns would be your concerns as well.

I am writing to you to point out the areas and opportunities of improvements, in hopes of some immediate changes. I feel as though my request and expectations are no more than any other rent paying adult who actually cares about their living arrangements. I am hoping to see these improvements to avoid having to seek outside assistance in doing so... Just so that I am clear, this is not a threat or me discrediting your abilities to manage the property; however, it is merely a request for change so that I can be a satisfied tenant again through the remainder of my stay. (This was sent to the Office Mgr. on 9/9/14...the following is her reply... with not one start to any of the concerns)..........

Diane – I am sorry for your experience and that we keep missing each other. To better address your concerns, could you please provide more detail on the following:

1. I am aware of the issue with numerous requests for the soap dish. It appears the tile/ceramic glue provided by our sales rep was not working properly, as designed. We have reached back out to him for a resolution on this. However, are there any other service requests that are not resolved to date or you had to call in multiple times?
2. I have discussed the trash issue with our Service Team and expect immediate improvement on this.
3. With regard to the valet trash, Waste Away has promised a replacement crew ASAP as we are very dissatisfied with the one servicing our site with the drippings being one of the reasons. Our service team is currently in process of pressure washing breezeways at a rate of two buildings daily. The trash being left at the compactor is also a result of the valet trash service which I have addressed with their representative. We have ordered a better working odor eliminating chemical for the compactor and look forward to seeing it in action.
4. The Cyber Café is currently undergoing renovation. We anticipate opening with new furniture and computers the first of the year, if not sooner.
5. With regard to our screening criteria and who we allow to become tenants, we are on the highest tier of screening for our company in accordance with Federal Fair Housing Laws. Anyone who qualifies based on this criteria is welcome to live in our community.
6. The drop boxes were closed company-wide (and almost industry-wide) as a result of extensive crime within the Atlanta market concerning drop boxes and rent payments in the prior years. As an alternative, we offer the option of online payment via check at no cost to you.

I have yet to see any attempt of improvements to any of these concerns, the price I pay is not in alignment at all with the quality of the upkeep of the grounds. Its so poorly kept that I dare to invite any of my associates over due to the complete embarrasment of it all. I am seeking to have a much better living environment without having to be inconvienced by moving out. If these listed things above can not be resolved and kept up on a consistent basis, then I should be able to be released from my lease without any penalties if neccessary. Please help! Diane R."
