Statement of Claim

I am writing this to hopefully enlighten people about Stanley Martin as well as other homebuilders that DO NOT stand behind their product. The end desire is for Stanley Martin to understand that the product that they sold for multiple hundreds of thousands of dollars is starting to fall apart. It is less than 10 years old. Further, they have known about these issues since the FIRST year. After that first year warrantee period, Stanley Martin has decided to wash their hands and not even discuss options to remedy. Also, I would like new consumers to know that while house’s look great the first year or two, they start to fall apart. You might say well, DUH. However, what people do not realize (pertaining to new homes only) is that Home Warrantees from the builder are poor. Also, people might not know that they can potentially negotiate better.

First, Stanley Martins warrantee is poor. Like many home builders, the warrantee is 1 year for normal stuff and 10 years for structural. The problem is that every home on our street is poorly built and have had the same issues. These are issue we see NOW. I am worried about issues we don’t see that creep up as the years go on. I am sorry, but I grew up in a house that is over 100 years old. It was better built than my house and we have WAY SUPERIOR technology. Further, Stanley Martin sold those homes for multiple hundreds of thousands of dollars. We buy a $20,000 car and have a longer warrantee than home builders offer. What does the Stanley Martin say about it? They say it is not their problem by simply stating it is not under warrantee.

My home is now 7 years old. The issues I have had - Drain pipes for AC not connected properly and draining into the framework of the house. - Roofing and shingles blowing off the roof. - The roof actually leaked and Stanley Martin STILL said it is not structural and my issue. Most of the outside wood is rotting on the house. And i don’t mean that it is showing signs of aging. You can actually very easily poke your finger through it. The house is piss poorly built. Stanley Martin has recently changed their the outside trim work of their NEW houses being currently built because of the issues they knew they had. However, they will not fix the trim work on existing homes. At the end of the day, I would like Stanley Martin to admit they need to fix the problem with our homes since we all paid hundreds of thousands to have those homes and I know they made plenty of money.

**I want to note that all of my surrounding neighbors (at least 20 I know of) have had the same issues. Some have spent $1000's of dollars to fix issues (including trim work) that should not have rotted in the first place. Most have ended up swallowing the money because Stanley Martin says it is not their problem. However, all the new homes in the SAME Neighborhood are being built with different materials now. I assume that is because they knew of the problems."

    Consumers need to look at their warrantee closely and fight to get a better warrantee. It is crazy not to get a longer warrantee on something we pay so much for.

  • Unfortunately, here there are several issues, but some stick out in particular - one, there is a contractor's standard warranty, which covers a period of time, usually not exceeding a year, of defects on the property. This is standard industry practice. Second, several of the issues sighted by the claimant would be something to address with the subcontractor that did that particular work. Trim work is not structural, and thus is not guaranteed by the ten year warranty. AC and roofing is usually done by a subcontractor, and therefore may have different warranties. This claim does not state any time frame with which to compare possible available warranties.
