Statement of Claim
Claimant says:
"Brand new fridge stopped working at 1.5 years old, technician says it was a complete system failure and will cost 900 dollars to fix as this model is not covered under 5 year warranty. . Only lasted 1.5 years, should have lasted so much longer. it is a lemon! Also, the technician broke the back panel of the freezer when he was assessing it, and when it was pointed out to him he said he found it that way, which was a lie, as I had just cleaned it that morning and it was intact.

RE: Investigation of Complaint with Sears Holdings Corporation
    Colleen Ellis – File # - 4143431-240031

    To Whom It May Concern:

We have been unable to complete the investigation regarding Ms. Ellis’ concerns with her refrigerator.

Upon receiving Ms. Ellis’ complaint, we reviewed the notes in our service and Point-of-Sale systems. The refrigerator was purchased on January 27, 2014, and delivered on February 5, 2014. The unit came with a one-year manufacturer’s warranty for parts and labor; this coverage expired on February 5, 2015. While we empathize with Ms. Ellis, we are unable to provide her with any assistance in regard to the repair or replacement of the refrigerator. Once the warranty expired, Ms. Ellis became financially responsible for all repair costs. While we empathize with Ms. Ellis and understand that she feels that the refrigerator failed too soon, we are unable to make an exception and provide her with a repair or a replacement at no cost. Doing so could have far reaching ramifications and would be unfair to our other customers whose appliances have failed outside the manufacturer’s warranty. As to Ms. Ellis’ claim that the technician damaged the freezer panel, she has been advised to contact Sedgwick, our third-party claims administrator, if she would like to file a damage claim. The number to Sedgwick is (866) 352-1521. If Ms. Ellis chooses to file a claim, Sedgwick will assign a claims examiner to investigate and render a final decision. With that said, since Ms. Ellis is not entitled to a covered repair or replacement, as her refrigerator is no longer covered by any warranty, we have closed our file.

We apologize for any issues or frustrations that Ms. Ellis may have experienced with Sears Holdings Corporation. We do value our customers and strive for their complete satisfaction including a reasonable resolution of any complaints whenever possible. If you have any further questions or concerns, you are welcome to contact me via email at Melissa.Lando@searshc.com.

    Sincerely,

    Melissa Lando
