Statement of Claim
Claimant says:
"I hired Scrivens Aug 12th, 2011 to pick up my garbage weekly. The fee was, and still is, $15.00 per month and the first bill was prorated from Aug 12th to Sept 30th for a total due of $25.75. I was told by the owner that I could get 'special' pickups as needed for $3.00 per pick up. At the end of Nov of 2011 I called and requested a special pickup. The pickup was 8 small boxes of old company brochures. Each box weighed about 12 pounds. I carried these out to the curb and placed them along with a large garbage bag of 'yard debris'. Everything was picked up and I was charged $3.00.

On May 16th I called and requested another special pickup. I had called to pay my bill and was told that I had to pay an additional $10 for being late. I paid quarterly, so I told him that I didn't agree with the late fee, but I paid it anyway. Why would he charge $10 late fee for a $15.00 charge? He said that he needed to make money and it was completely within his right to charge anything he wanted. I decided not to argue with him and requested a special pickup for the following Friday which was May 20th. I told him it would be the same boxes of brochures and yard debris, the same as before. He said I should just leave them by the porch and they would be picked up. I did, and they were.

The following Thursday I got a bill for $27.00 for the yard waste, wood, tile, and boxes of brochures. I called to inquire about this and had to leave a message. I asked him to call me back to explain the charge and the fact that the bottom of the bill shows a total due of $46.50.

I did not receive a call so I call him today and left him a second message to call me.

He called me back later and started out by telling me that he had returned my call and that there was nothing wrong with the bill. He said that I should appreciate that he went above and beyond to pick up my large number of boxes and that he had to take my garbage can full of debris and junk to another town and dump it and drive back to bring my can back. He said that the boxes of brochures he dropped behind Kroger's. I tried to tell him that I had a problem with him not telling me what it was going to cost ahead of time. The more I tried to talk to him the louder he got and the more abusive his language became. He said I was white trash trying to get over on a black owner, and every other word became an 'f' word. He continued to call me names and said that he didn't care if I didn't pay because he would let the late fees add up and put a lien on the house. Then he hung up. I just can't believe that a business person could act like that towards a paying customer. He wouldn't even let me talk. If he had told me in advance that the pick up could cost up to $30 depending on what it was, I would have had a choice, but in this situation, I believed that the charge was to be $3.00 not close to $50.00. He just kept on insisting that I should be grateful and appreciate what he did. He did say that if I had called anyone else the charge would have been $30 to $40. I'm not sure that I got any deal whether it is $27.00 or the bottom of the page total due of $46.50. Please help to get this resolved. I don't mind paying a reasonable fee, but I do mind being call a racist and there was no reason for the foul language."

  • The charge for the service was $3.00 the first time. When I requested the special pickup the second time, there was no mention that the amount would be increased for this pick up. Also, the bill has two amounts, one for $27.00 and the total of $46.50. I was cursed at, screamed at, and call a racist. I want an apology and the amount reduced to $3.00. If the pickup person knew the amount was going to be more than the $3.00, then he had the ability to leave the receptacle and call me the next day to see if I still wanted it done. Charging me an amount that is almost 2 times the amount of a full month of garbage pick up is not acceptable to me. The monthly fee of garbage pickup is $15.00 and the late fee is $10.00. He threatened to keep charging me late fees at $10 per month until either the bill was so high that he would file a lien against my property or I paid the bill in full. That is not an acceptable business practice, that is bullying me into paying just to make him stop, even if I don't agree with the bill. I am paid in full until July1st at which time the service will be cancelled. I will no longer do business with this company. I wouldn't mind paying for this service, but I should have been informed in advance of the pick up if there was a major change in price.

    I have paid in full for service through June. Last night, June 4th/5th, was the designated pickup date, and the garbage did not get picked up. This is getting out of control. He knows I am moving the end of June, so he is making it difficult for me to get service until then. I have already paid for the service and I am not getting what I paid for. All I ever asked was for the charge to be reasonable, and an apology for the racial comment and bad language.

    I received a 'past due' notice today, Aug. 13, 2012 from Scrivens. It includes a $5.00 'special' pickup charge. I have not had service from this company since the end of May. Even though I was paid in full until the end of June, he did not pick up my garbage. I hired Eagle Waste Management to pick up for me for the month of June. The Scrivens receptacle was left outside the garage for him to pick up, but as far as I know, he never went over and got it. It is still there. I, however, am not. I moved to Florida on the 22 of June. I am appalled at his nerve in sending me another trumped up bill. I am really tired of business people who think that because the amount is small, we will just pay to have them go away. I will not be paying this idiot one more penny. I will make the trip back to TN to see him in court if I have too. I just want him to go away.

    For anyone who is considering using this business, please see the websites of the BBB and city search. They show a lot of bad reviews. I am now going to Angies List and some other web sites to report my experiences as well.

  • How could a company comit to picking up anything at anytime for $3.00? We charged you a $3.00 for some business brochures in which I stated the fee was so small because a supervisor picked them up and put them in a recycly bin behind a area kroger store. So in good faith I did not charge. You we billed for the additional 2 hauls based on what our normal fee structure was at that time. Anything else you claim is just not true!

  • You used profane language, called me a m'f'er, and now you are calling me a liar. All because I asked you to tell me what you were charging me exactly, and what you were charging me for. Now you are billing me for service after I moved and AFTER you refused to pick up my garbage, which I had already paid for. So you need to check yourself. I am not the only person who has had bad experiences with your company. You did not provide any service to me since the end of May, even though I was paid in full through June. I hired your competitor to cover the month of June. As for those other complaints on the web sites, I doubt that all of those people would agree with you, since one of them was for fraud on her credit card. Look again. Other complaints were for foul language, rude behavior, and billing errors unresolved. I am going to now send all of this to the County Supervisor and ask that your business practices be investigated. OR you can admit that your bill that I got today was a mistake and go away from me forever. It is your choice and it is a simple one.

  • I am retired and living on social security. I have nothing but time. I do not owe you anything and until you mark my account paid in full, I will spend time to let everyone know what kind of business you are running. You don't get to call your customers names and make bogus claims and charges, and then stop picking up the garbage without notice, even though it was paid for. I should charge you the cost of hiring Eagle to do what I had already paid you to do, but I won't because I am better than that.
