Statement of Claim
Claimant says:
"I made purchase on July 18, 2012 and I tried to return all products on July 19, 2012. According to State law a person has 3 days to return. The receipt says no returns or exchanges within 14 days that infers you have 14 days to make a return. They did not honor what was written on the their receipt. I talked with the males at the kiosk who gave me the manager’s number. He said, in essence, “tough luck, lady.” This manager whom I believe Rona alluded was her boyfriend whom she hoped to marry had Rona call me immediately after that with the same line of tough luck. I explained that I did not realize until I returned home on July that my son reminded me that the payment for a critical work course for his career was due. I didn’t have it for him after being sweet-talked out of $ for skin products. One product was used due to gold like material flaking from outside of cap and product inside cap and rim.

Rona is a very pretty Israeli woman who was insistent that I try sea salts scrub just to see how salts would exfoliate my hands and they would feel smooth. She continued on and on with her sales tactics of going from one product to another calling me endearing names pretending she wanted to be my friend. She rang product after product even though I voice vigorously that I really couldn’t afford the product. Rona kept complimenting on my skin appearance after trying products. I am 61 and look as though I am in my 40s which everyone comments on. I certainly didn’t need wrinkle treatment products.

Rona is a smooth operator who said she would give me some product at her cost but not to tell anyone or she would get in trouble. She also presented some free product for my guys. A free facial was promised but I never received that. She may have mentioned BRIEFLY there was no refund. My bill totaled over $3,000!

I feel the sales talk, promises, products for Rona’s cost was fraud by deception and theft by coercion. Their fraud is quite apparent with no return no exchange after 14 days which is printed on receipts which again is not honored. My signature does not appear anywhere on copies of receipts I have.

I have tried several products and I did not like the sea salt scrub and I am allergic to fragrance in something not even on Gratiae’s web site—Onsen. How do I know I have the “real” thing as advertised as being from Israel when products can purchased on the Internet for considerably less?

The kiosk looks quite different now. I don’t recognize products being sold.

    When I arrived home much later than expected, my son told me I need to pay tuition for a course [he will be taking] plus other expenses within the next week or so. The money I charged for skin care, I am requesting a credit or he will not be able to attend. This is very imperative to his career. I would like to return for credit [...although your receipt states "No returns or refunds within 14 days" indicating I had 14 days to return...] by asking permission from your management tomorrow. In the State of Texas returns (and hopefully credit quickly) are allowed within 3 days. This is day 1.

    Your help would mean ever so much to me and especially my son. I have no other way to help my son other than have my credit account credited.

    I will bring all the products to you tomorrow (day 2) or Sunday (day 3) at the very latest. I have [not] tried any of the product. It is in original boxes and condition.

    Thank you for your help. It would be the kindest thing you could do for this mother who needs to take care of her son.

  • I received a phone call from Rona on 3/28/13 with a message to call her. I returned the call the same day and no answer. I left message that I called. I e-mailed as well. To date (4/4/13), I have received no other communication from Rona.

    As you are aware by now, I have filed a claim against GRATiAE Organic Beauty. The website is peopleclaim.com and the e-mail is support@peopleclaim.com. The claim # is 2469824-214414. I would appreciate your immediate attention in order to assist peopleclaim.com contact the appropriate manager's name or the name of the leasee of the Stonebriar mall kiosk, address, e-mail and phone number in order to resolve this matter immediately. People.com is handling all matters, but I have asked for additional help with settlement. The GRATiAE Organic Beauty address on the web is a warehouse. I need to know who at Corporate Headquarters (??Israel) is President or Director of Operations, proper Company name, address, telephone number and e-mail. No information is available on the international website GratiaeCosmetics.com.

    As soon as the claim is settled, I will remove the claim along with attachments and any additional information. Nothing will appear on the internet after settlement including any reference to you.

    Please take this seriously. I do not understand why the company who believes they have a good product and wants a pristine record would not want to settle with a very dissatisfied customer, a customer who received used product as well as feeling fraud and deceit was involved. I truly do not know if I was sold the authentic product with receiving used product. As I understand it, Texas law allows all returns within 3 days. I tried to return product the next day but was turned away by your manager, you and the other sales associates. I feel I am due the money requested. All I want is my money (cash) and to return the product after receiving settlement closing this incident out. Please provide return address for the products.

    I feel it is in your best interest and that of Gratiae to cooperate to settle this immediately. Please e-mail the requested information to me and directly to support@peopleclaim.com.

    • The store policy is “NO REFUND ALL SALES ARE FINAL” We offer a 14 days exchange/swap for any unopened / defect product.

    • We explain our policy to all of our customers.

    • We have a sign next to the register that explains our policy.

    • We also put a note on the register receipt with our policy.

    • We have a line on the sales draft that explains our return policy

    That present our product online the costumer service can confirm that. There number is 1866-594-7546.
    • We do not compete with any online website and we never promise to give the best prices for our goods.
    • The demonstration process takes at least 30-45 minutes, during this treatment we explain to the client how and what exactly the product do to there skin. We do not charge on this facial nothing this is part of our service. On any other spa/saloon 45 min facial cost $75-$250.
    • All goods sales on any website other then the official website can be expire or replica/imitation we know that because we already deal with that in the past.
    A simple phone call to the customer service could confirm all that says here.
    • We are deeply sorry for the inconvenience Ms white feels but we do have thousands of happy and return costumers. We are trying to do our best on customer service and we hope to do better in the future.


    • We are sorry but we cannot apologize for our sales tactics. Sales are part of our training process for our employees.
    • Miss Rona was on a vacation overseas for couple month and that was probably the reason way she did not contact Miss white. We do not asking our employee about any of their relationship outside of work hours.
    • If Miss white have any defect, unopened or allergic reaction for any of the cosmetics she have purchase with us we promise to change it for a new one Even though passed more than six months.
    • We will try to do our best to make Miss white satisfied.

  • In response to Mr. Kadosh's April 10, 2013 message, I am upset with the response regarding business tatics (ethics). I cited concerns about deceptive sales practices and fraud in Gratiae's sales approach in my communication to the company. Mr. Kadosh's response today was "We are sorry but we cannot apologize for our sales tactics. Sales are part of our training process for our employees." This says to me that Gratiae Organics/Guy Kadosh as a manager/owner will do whatever it takes to make a sale and sales associates are trained in deceptive practices.

    I feel I should be reimbursed for the $3,000 as well as the facial that is due me. I do not want Gratiae products in my home because they represent unethical business practices. I cannot be sure I was sold authentic product.

  • GRATIAEORGANICS.COM website has been posted as CLOSED as of April 2013. Therefore the suit should be filed again against Mr. Kadosh unless this company no longer exists.

  • I am experiencing a similar situation now but thankfully did not spend as much as Ms White. This company uses sexual harassment and bad business practices to lure people into a sale which not sharing their store policy until you have signed the receipt. I was personally told I COULD RETURN the products MANY TIMES but that he was giving me a GREAT DEAL - JUST FOR ME...and that I would be so happy I would want to refer my friends. I don't think so. This company has been nothing but horrible to deal with and I am disputing with my credit card company as we speak. I will take further action if I am denied full reimbursement based on the companies lies to Visa again.

    The told Visa they DONT SELL THEIR PRODUCTS ONLINE or over the phone. (LIE #1). As I was trying to see what else I could share with Visa about this awful experience, I started to find all of these other complaints against the company online. Found that they operate under different business names...and this one grabbed my attention because they offered to replace my products which I had an allergic reaction to with their Gratiae products that are supposedly the best - my dispute is for around $250...were they planning to UPSELL ME ON A SETTLEMENT? This is one of their more expensive lines of products.
    Third, I was also told that I was getting free things thrown in and just for me, etc...well interestingly enough, they didn't have prices on their products at the kiosk - it's alllll starting to make sense. FOURTH, I found that one of my receipts was FOLDED UNDER THE SIGNATURE LINE and...ABOVE THE RETURN POLICY LINE...hmmm? AND the salesman held the receipt while I signed it, now I think he was hiding the return policy which was NEVER mentioned to me - I NEVER buy thinks that cannot be returned as I believe that is poor customer service and they are hiding something from the start. FIFTH, I had told the guy I had very sensative skin and was on a regimen and not in the market to spend money but he still managed to use harrassing high pressure sales tactics to get me to not buy just ONE set of items, but TWO immediately luring me back in after the first sale was finished.

    The list continues but you get the idea. I see a similar pattern here as what I have read elsewhere and here online. Absolutely horrible business practices. This company should be SHUT DOWN!

  • Had same thing happen to a friend that is about to undergo surgery and was not feeling well when they approached her with the same tactics. Offering free stuff and don't tell anyone as I will get in trouble. She made purchase and 15 afterwards tried to return and girl said they could not return as she would get in trouble. I had similar experience while in Las Vegas. Scam and should be not be allowed in a mall like Stonebriar. North park does not allow kiosk. I understand why. If product they sell will make you beautiful they should gladly exchange as department stores and most any will do within at least 3-14 days. This type of sale and the pressure is fraud in mine and most others opinion.
