Claimant says:
"I sold Deyanna a 1998 Dodge Durango in Aug. of 2012. She since then has complained of
several problems that has came up on the car. I find them hard to believe as I have drove
and maintained the car for 4-5 years with no problems. All of a sudden, they show up. The
contract clearly states "VEHICLE IS PURCHASED IN "AS IS " CONDITION" and sold with a regular title. She has since then sent me $50.00. I am looking for the balance of the purchase price plus expenses occurred. I would still be willing to work with her on payments
if she would. If not, I want the car back. I have been more than fair through the whole process.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "I purchased a vehicle from mr spears under the agreement if a valid title. Mr spears did not get me a valid title for 8mos. That's beyond a reasonable amount of time. This car was legally un driveable for 8mos voiding the agreement. In good faith I offered mr spears a fair amount of half of what was owed. This amount was 400. In the letter with that offer was a money order of a 50 pmt as per mr spears comment pay what you can monthly. accepting this payment was accepting the offer. Further more if this goes to trial I have recorded conversations between mr spears and myself along with letters proving my case. This podt on this site is slander and deffemation of my character. I lost a job because no transportation and two tickets .im aware in the beginning I decided to drive so the tickets are my responsibility. If I had been able to drive the car I never would have been put in that position. My spears voided the original title with sticker this is his fault. There was never a statement made by me saying I didn't pay due to the mechanical problems of this car. It did have break issues. When I purchased the vehicle the break light was on . Mr spears told my father and I that the light was on but they were checked and it was fine. We took his Word. Less then a month after buying the vehicle the brakes went completely out while u was driving home from work. Not only was this dangerous If my kids were in the car or I was on the highway it would have been deadly.i was simply informing this "good guy" how much danger he put us in. This was never the reason for non payment. I believe mr spears didn't believe that the title was voided and he took his time getting me a title for that reason. I would never had purchased it if I knew I could not drive. If this goes to Cory I'm more then confident I will win. I agree to pay the 350 left in payments of 50 monthly as per our agreement. That's it. If this goes to Court this post from mr spears will be evidence of public deffemation of character . The lies told in this post are just that lies. Again I have phone calls and letters. Not to mention mr spears sent the police to my home town to my dads house when he was told assoon as I got title it would be paid. That was the second month of waiting. I always made sure mr soars had my address and phone numbers. He had no reason to embarrass me in my home town when the reason there wasn't payment was due to his negligence. The fact that mr spears tried to add an extra hundred is very laughable. If taken to a court of law I will be counter suing for defamation, lost wages, and the 25 I paid him when I finally got the title for the title just cause I thought since he drove it all the way Down I'd pay for it. Right after I handed him the money he says he had to confess that he had an apt in Des Moines so he didn't make an extra trip he was in the area. It's unfortunate that he claims to be good but caused me undue stress and danger and financial hardship, knowing I'm a single mom, and refuses to address that. Good luck Mr spears . I'm going to ask this part be taken down by Mr spears due to the lies included in his reason for posting this. "
