Statement of Claim
Claimant says:
"On May 11, 2012. I agreed to a free trial facial product, introductory price of $5.95 Received the product but got a credit card bill of $89.95 on May 26, 2012. Received another shipment of product on July and notified company of erroneous, unauthozed automatic refill. On July 27, 2012 the company charged my credit card $69.95 Attempted to contact company by email and phone , but was unsuccessful. The company has an invalid e-mail address and a phone message that refers the caller to the e-mail address.
On Aug. 7, 2012, I received another kit. I returned and mailed the kit to Israel; incurring $30.00 for postage."

    "Dear Zenaida,

    On 2012-05-11 at 15:15 UTC we received your order for a 2 week trial of our 3-step Dead Sea Beauty Kit, with retail value of over $200.

    By placing your order, you had to agree to the Terms and Conditions of our risk-free trial offer which state that you will have 2 weeks to evaluate our product completely free of risk to you. If you are not fully satisfied at the end of the trial period, you can simply notify us and return the trial kit to us, without having to pay for it. The Terms and Conditions which you agreed on upon placing the order also state that if you do not notify us during the two weeks, we would charge you the discounted cost of our Dead Sea Beauty Kit, i.e. $89.95.

    More specifically:

    Risk-free trial offer: By buying this Special Trial Beauty Kit, you agree to enroll in our Autorefill Program. You will be charged applicable shipping and handling fees upon placing the order and will then have 14 days to try our products and return them if you are not completely satisfied. If you choose to keep the kit, you will be charged the full cost of $89.95 and will receive replenishments every 30 calendar days at $69.95. Your card will be charged accordingly upon dispatch of each additional package. AutoRefill can be cancelled or modified at any time by simply logging into your account or contacting us. Yet, we have no records of you attempting to get in touch with one of our Customer Care specialists.

    Please bear in mind that we have recorded your IP address of 69.237.68.27 and it matches your specified delivery address location. Furthermore, we have proof of delivery of the trial package to your address, which also matches your IP address. This is a $200 product that you received as a risk-free trial for only a small S&H charge and we log all transaction data to protect ourselves from consumer fraud.

    In the event you dispute the charge with your your bank, we will provide all the above information to them, which could result in consumer fraud investigation towards you and could potentially affect your overall standing with your credit card company (e.g. Visa, MasterCard, American Express, Discover, etc.).

    I would like to point out that we work within all card associations rules and regulations.

  • This company is using devious methods to sell their products. Once a shipment has been made they assume that they can continue shipping further product without the customers permission to do so. I will continue to persue this company and make sure that UK customers are advised, with the help of our national newspapers, of their selling methods and also send the details to the Washington Post newspaper who regularly carry the company advertisment.
