Statement of Claim
Claimant says:
"I hired this contractor Johnathan Critchfield 907-388-4203, 907-371-0573 of Absolute Alaska (Fairbanks, North Pole area) that also use to be Affordable painting to construct a foundation for my shed, assemble the shed, demo the old shed and paint the inside of the garage. Upon signing the contract and paying him half of the money we agreed to a start date three days later. He/his company was suppose to start work on a Wensday but they never showed up or called. After making numerous phone calls the number given, days later his friend Kelsey answers the phone and explained he had personal problems concerning his kids and wasn't able to start the work. I explained to her that I understand that things come up but I should've received a call. We were told he would start the following week, again no one showed up, after making numerous phone calls Kelsey answer again, calls Johnathan and he promise to send someone over to start, again "no show, no phone call. Again we called the contractor was still unresponsive. Finally several days later he shows up apologizing, he send one person over to start the demo, the person shows up late in the afternoon to start the demo. His worker let trash in our yard for a week. His worker shows up one day the next couple days as a no show. We called again Johnathan was still unresponsive. Finally he return our call and shows up explaining he had to get rid of the guys because they weren't working. He never checked what his worker was or wasn't doing. If he had checked he would have identified the problems early on. When I approached him about him again being non-responsive he became offended and threatened to quit. He and two worker constructed the foundation, I asked if he used green wood which I requested he claim he did, but I can't tell because he had already cover the foundation. He built a ramp in which the ramp came apart from the foundation, we called and again after several days we got a response. My husband and I called several times, most of the time he never acknowledge the calls. After several more days of calling and no response he finally answered the call. When I began to question him about his work ethic, he again became offensive and told me to find another contractor to do my garage because he had 13 other jobs he was doing and then he hung up the phone. Please use caution when using this contractor. He is very unresponsive and his work ethics are questionable."

  • At this time, we are not accepting your offer. There has been multiple times we tried contacting you to resolve this issue via telephone and there has been no answer or even, a call back! During our work contract I, myself have kept in contact with you. I even tried settling this dispute with you via telephone and YOU chose not to discuss or move forward from this due to you being out of town, when I called your office number that is located in Fairbanks. I do want to apologize for the employee we had that first started working on your shed, he was not a good fit for the company and we had to let him go. For one example, the work he performed on your property was unacceptable. Which is no excuse, nor am I making it one on our end.
    The total cost of the contract came out to $1,926.00 which we discounted $200.00 off the entire contract, the new total comes out to $1,726.00. The total cost for demoing the old shed and framing the new platform came out to $496.00. Installing the new shed was a total of $350.00. The total cost for painting the garage is a total of $1,080.00 with discounting the labor at no charge for cleaning, degreasing, and painting of the garage floor. Also, we did not charge for a total of seven dump runs.
    You have stated that you paid half of the contract which is a total of $863.00. The work we performed (demoing old shed, framing new platform, and installing new shed) comes out to $846.00. Technically, you have not paid full price for the work we have performed, but we have no complaints about that towards you. So I am not sure how you feel ripped off?
    Now, after we demoed out the old shed and right before we were about to perform installing the new shed, your husband left a note outside which was very offensive to our workers and most of all Jonathan. His note was down grading our work ethic BEFORE we even started building the new shed! First of all we would not come all the way out to bid the job, accepting the job, and get ready to do the job if we did not know how to do it. Jonathan has over 20 years experience in this trade and I am for certain and positive he knows exactly what he is doing and does not need anyone to write it down word for word telling him to make sure he reads all instructions and not to leave any parts/screws out of the shed. That was a bad start for us on your end, but we still completed the job.
    On the days we did not show, which was due to bad weather conditions, you told us you understood that and it also states in the contract you signed under Article 6 #3 "Contractor shall not be liable for any delay due to circumstances beyond its control including A) weather B) lack of material available in stores C) acts of God or of the public enemy D) fire E) floods F) other trades G) owner changing date H) lack of heat I) lack of insulation J) other installation not done by Absolute Alaska." I do apologize for the weather we had this summer, but that is completely out of my control. For the other half of our contract agreement painting the garage, I tried scheduling our workers to get in there after the shed was completed and you said you were not ready for it to be painted until the beginning of the next month of July. We waited and were ready to get the garage painted in the beginning of July but you did not have the garage prepped or cleaned out until the End of July. You then became upset that we could not schedule any of our workers to get in there the very next day after we received your call. This goes back to Article 6 in the contract stating Contractor shall not be liable for any delay out of our control “G) owner changing dates”. We tried scheduling a different time with you since we were unable to start at that time, which is when you became very upset with Jonathan. At the time you finally got the garage ready (a month after the original start date) was at the end of the summer work season. Please keep in mind all contractors get very busy at the end of the summer season wrapping up all their exterior jobs. Ms. Gaddis, we have tried scheduling a new start date for the garage that was fit for both of our schedules and you became very rude and unpleasant towards Jonathan when he was trying to work out a new start date. That is when he decided to just end the contract because the relationship with the Contractor and Owner was not working out.
    I would understand if you felt ripped off IF you have paid for the other half of the contract to get the garage completed, and we started and did not complete the job, but there was no payment for the garage whatsoever and we did not even touch the garage.
    Also, every contractor that has been at your house states that you are a very hard person to satisfy, the work they performed does not meet your satisfaction needs and you want to be discounted for all the work that has been performed on your house. It seems to me that our company is not the only one you choose to pick apart. You keep wanting more discounts when we have discounted a great amount off our contract to begin with and Ms. Gaddis, I’m sorry all of the work you want done on your house can’t be discounted or free. You want the work done, you must be willing to pay the price even after all the discounts we’ve given you!

  • 1. Claimed filed with BBB on 9/1/2016, after multiple emails from BBB you finally responded on October 24, 2016. Again showing behavior of being unresponsive.

    2. Yes, Kelsey called me (1) time and I told her I was traveling. Upon my return I called and left a message at your office, again you didn't respond until October 24, 2016. IF you called me several time at my office you left NO messages not did you call my phone and IF you wanted to get in touch with me, you could have emailed me.

    3. With the contact that we agreed upon, you never started the work on time, you were several week late. One of the weeks you were unresponsive and no contact at all. When Kelsey finally answered the phone she explained you where having personal problem which I won't reveal to the public. I do understand we all have problems from time to time and we agreed to continue to have a working relationship and YOU promise to communicate better and come by and check on your worker...which you FAILED numerous times. If you had check you would know that that these workers that hired wouldn't show up to work and when they did the wasn't getting all the work completed that you had given them to do. Being the OWNER/PROJECT MANAGER you should at least check the progress of the work being conducted. Again, you FAILED to do this even after we had called you multiple times.

    4. When the contract was drawn up, you agreed to give us a military discount which was the only discount that you gave us. We never ask you to do anything free but paid you a fair and reasonable price in accordance to the contract and the scope of work. Johnathan never provided a material list which would have supported the breakdown in cost. As far as the dump runs, you had me under the impression that all of this was include in the price of the contract. I called your office and when you finally responded to my call YOUR worker had left 7-8 BAGS of trash in my yard for almost TWO weeks. (I have pictures to show),

    5. I do understand that when a project is outside and IF weather doesn't permit the contractor working outside, then as a courtesy call the customer. My husband and I would constantly call his office and leave messages and wouldn't get a response. Our family alternated in being at the house so he could get the shed out of the garage, keep in mind were taking off work adjusting our schedule and the contract or his worker never shows up or cal. This happened on several occasions.

    6. As far as other contractor having problem with me...please explain and disclosed who you referring too, so I may address them.

    7. I ask that the foundation be constructed with green wood, Johnathan covered the foundation before I could see it Not sure if this contractor did what I ask.

    8. Yes, my husband did place a note on the box not to take short cuts because we had had so many problems with getting him and his worker to have a consistent work flow and because he showed no interest in meeting his schedule time frame in completing the job.

    9. My husband had to call you several time before getting you to respond to if we could start moving the items from the garage into the shed because it was so hard to get you to respond. When a contractor quotes a job, the price should include everything it will take to do the job unless the customer is told otherwise. My husband and I wasn't told anything different. Again, Jonathan not communicating clearly and putting these things in writing. The first contract he gave us to paint the garage, when we had stated we wanted the floor painted also. He then come back and tell us if we purchase the paint he would paint the garage floor and that he would come in and power wash it.

    10. After several attempts to get a hold of Jonathan to start with the painting on the garage, he finally answered the phone and begin to make excuses why he hadn't contacted us. He tried to blame it on use not contacting him, but this isn't true. I expressed to him the thirteen other jobs he was doing and that I could find someone else to paint the garage and he hangs up the phone. This doesn't seem too professional to me nor is someone I would want to every to do business with again, unless some changes are made. We fund another contractor to paint our garage which cost us more, but the job was completed with three days, the contractor was responsive and courteous. It was worth paying more to get the excellent customer service we received. It's not always in your favor to go cheap because you get what you pay for and most other times you get substandard and less.

    11. Finally, I would like to say, my husband and I tried many time to resolve this at the lowest level, we tried being understanding and working with him but I guess our job was to small and wasn't important enough for him to give the same type of customer service that he says he gives to others.

    12. My husband ran into Johnathan at the gas station, he told my husband that he had been to our house but no one was there. My husband was surprise that Jonathan would say this, especially when my husband had been at home all morning and had just left the house when he ran into Johnathan. On top of all the things we had gone through with this contractor led my husband to start questioning his honesty.

    13. I won't go into details about the scriptures that was in Jonathan comments, but will say, God still love you and he wants you to do what is right!
