Statement of Claim
Claimant says:
"We live at the corner of Chinden Blvd. & Discovery Way & last Fall some construction work was being done on the S.W. corner. (We live on the north side of the street). The construction company doing the work rented a small 2 wheeled trailer with 2 yellow flashing lights to show people that work was being done. Roots Rents delivered the trailer & took it away. When taking it away they ran over one of our Rain Bird sprinklers & just crushed it. I called Dave Roots Sr. & told him about it & he said they would replace it. I said "that will be great but I don't want it done now because the water has been turned off & to wait until Spring." He then said okay. I have been calling him for a while to remind him. He seemed friendly & accepted it. Then last week he wanted to know the # on the sprinkler & I told him & he said ok. I called him again this week & asked him when he was going to fix our sprinkler His answer was that he was not going to fix it that I would have to pay someone to fix it. I had told him all along that it would have to be installed. Then he said that he had mailed me a new sprinkler & didn't I get it. I said no that I had not gotten it & to this he said "honestly & truthfully I mailed it." My reply was "you're lying to me & I have to have it installed because my husband is deceased." I had told him all along that it HAD to be installed. He is responsible for replacing it & that I do not like being lied to."

  • We had rented a light plant to a customer and when they moved it from the street to where they needed it they must have run over the sprinkler. When notified by Ellie Flinn about the sprinkler we agreed to replace it and on May 10th it was mailed out. We had never agreed to install it as we are not sprinkler repair people. A week or so later it came back to us marked "return to sender" for reason of "no such number". With the contact # being thrown out after it was mailed we had no way to contact her. When she called to ask about it and was told that it had been mailed, we did not know that it would be "returned to sender" This claim is the first I have heard about it sense. It is still sitting in my office in the postage box. I would be happy to get it to her but we apparently have the wrong address. We did not lie to her about anything and have always run the business with great integrity.
