Statement of Claim
"On Aug 14th 2015, I was unofficially terminated. After I had explained to another employee the day before that she'd made a major mistake with putting a name as a business owner on the wrong business and location via email, which I sent 4/5 emails to her telling of this mistake. She then tried to tell me the business location was closed! It wasn't, and she'd added the name to the wrong location to start with. The employee then called me and argued with me over the phone stating the same thing, until I finally told her "Nevermiind" I'll take care of it, just don't make anymore changes to this.
I got off the brief phone call with her and went back to doing my work. That next day, my supervisor Brandon Baker pulled me into his office with Jennifer Fabrick the acting HR person to harrass me over what had happened stating the Inna stated I'd been hostile to her over the phone, and she didn't feel comfortable. They pulled me off my work duties for an hour not letting me leave his office, until Jennifer then went to get the president Sheryl Rickert. Sheryl then became very snotty with me in stating that when I get under stress "You push your chest out and you eyes bug out." She has never seen me under stress, and the only time we had a conversation in her office is when I had to go in upon my request to fight for May's bonus check which I had given Brandon Baker all signed paperwork for in which he failed to submit for my bonus thus making me loose it. That is the only time Sheryl Rickert spoke with me until one time after when she interviewed all sales reps on how to make Brandon Baker a better Sales Director! Which I told her specifically he sets an atmosphere for fighting on the floor between reps and doesn't look out for their best interests.
After I requested to speak with her directly in her office, alone with Brandon and Ms. Fabrick, she added another person in her office to observe then repeat what Brandon had stated. They both claimed that others in the office had heard me swear when I left his office as she was right behind me that day upon walking out. I did not swear and we walked out of Brandon Baker's office straight into hers.
I've been accused of hollering at another employee which I didn't do that day. My tone changed as I felt she'd made a big mistake, that was about 30 seconds on the phone.
I've brought them in thousands of dollars in my sales, and I've witnessed 3 other seasoned well earning female reps go out the door, for reasons unexplained. I feel there is a biased attempt on part of Brandon Baker to rid all female employees off his floor, especially the ones that question BBB's practices.
One other point, an attorney from Irvine who had sent an interest form was given to me the day before the incident with Inna in which the attorneys office had no idea where the complaint came from as they had never worked with that client nor could they locate them. I was asked after I'd contacted them by Brandon Baker to give back that interest form to him because he wanted to handle it. I asked him why, and he stated that he felt they were just trying to find out more about the BBB's complaint process. So I stated I didn't mind and left his office.
Lastly, I feel I've been unjustly terminated when I was ready to sign the document upon their request to work with them in any such escalated problems that may arise. When I asked to write my response as there was a section on the form for me to do so, Brandon and Ms. Fabrick allowed me to go back to my desk to write it. When I returned, Ms. Fabrick stated that Sheryl the president, had stated that employees had stated they'd heard me swear upon leaving Brandon's office in which I didn't and then asked me to sign a termination form which I refused. I then took the form of conditions of employment and folded it and got up and walked out. They shouted at me stating I couldn't take that, and I stated back, your not having it. Brandon then proceeded to hand me a box to get my things off my desk, in which I refused to use as I picked up most of my items and left."

  • THE BBB HAS THE RECORD OF DOING BAD BUSINESS. IN 2010 THEY WERE BUSTED BY 20/20 ABC NEWS FOR PAYING TO PLAY. THE CHARGE BUSINESS'S TO HAVE A BETTER GRADE AND TO BE PROTECTED.
