Statement of Claim
Claimant says:
"I have been charged a fine for My granddaughter breaking the gate in a gated community
by following to close to another vehicle. In their "Amended and Restated Bylaws" it states
"Any notice, Information or other written material required to be given to an owner or director under the Declaration, Bylaws or Oregon Statues may be given by electronic mail, to a lot owner or director who has given assent to the electronic notification and balloting process. However, electronic notification may not be used to give notice of: a - Failure to pay an assessment; c - An action the Association may take against an owner. On the electronic statement the association put in the statement : CC&R Infraction with a penalty of $50.00. The tell me because I gave assent that they have the authority to include this on the electronic notification. It clearly states However after the given assent. So I believe that They cannot say that by given assent to electronic notification when it states However that this cannot be put on the statement."

  • I have gotten some information regards to the electronic notification. "I suggest it means that anything but notice of default on an assessment may be given and delivered via email. But any default notice of monies owed should be made by first class mail or certified with a return receipt requested. And there should be a provision in the CC&R's in that regard... If not, it still stipulates that it cannot be done via email."
