Statement of Claim
Claimant says:
"I was sold a vacuum under false pretense, I was told the vacuum I brought there to be repaired was made by Panasonic, the vacuum was a Sears Kenmore Progressive vacuum, The owner told me all of Sears vacuums are made by Panasonic, which was false, he also told me when I told him I wanted to buy another Kenmore vacuum and I was told a Sears was coming to town, he told me it was going to be another business moving into that space and not a Sears, He assured me that Panasonic made all of Sears vacuums and he had one there in the store for sale, I looked at it, it looked similar, my vaccum is 11 years old so I thought maybe the style had changed a little. A week after I bought a vacuum from him the Sears store opened in the space I had said, I went there and found out that there was not one vacuum there that was made by Panasonic, They showed me who made their vacuums and it was not Panasonic. I didn't open up the box and assembled the vacuum for 6 days after I purchased it, when I did try the vacuum it was so loud I thought for sure there was something wrong with it because my old vacuum didn't sound like that. I packed it back up in the box and took it back to the store and told the owner this vacuum is not like my vacuum it sounded like an airplane taking off, and I found out that Panasonic does not make Sears Kenmore Vacuums, so it is not like my vacuum and my old vacuum was not made by Panasonic, he offered to give me money towards another vacuum but he said this is a used vacuum now and I will not give you back the $350. for it. At that point I certainly didn't want to do business with someone who lied to me about the whole transaction. He had nothing to say when I told him Panasonic doesn't make Sears vacuums. I took my old vacuum there to get repaired a plastic collar that holds the hose into the canister cracked and a piece broke off. he said that piece could not be replaced that I would have to replace the entire hose and control handle at $112. I thought the vacuum being 11 years old I didn't want to spend that much on one part of the vacuum, after I decided to buy the Panasonic vacuum he asked me what I would be doing with the old vacuum, I told him I would just take it home and throw it away it doesn't work. He offered to take the vacuum and dispose of it for me, he actually fixed the vacuum and sold it because he no longer had the vacuum in the store. I went on line and found the part that needed to be repaired @ the vacuum repair store.com for $7.99. He had told me that that part could not be replaced, I don't know why a vacuum repair store on line would sell a part if that part couldn't be replaced, they wouldn't sell any of those parts.
So the owner lied and deceived me on many things, the maker of Sears vacuums, that the Sears store was not coming into Keene, NH, the part on the vacuum that needed to be replaced was not replaceable. When I called him on these things and the fact he no longer even had my old vacuum, I asked if he fixed it and sold it, he insinuated I was calling him a thief and told me to pack up my vacuum and get out of there. I have never had such poor customer service in Keene, NH in my 40 years of doing business here, the vacuum is still in the box, and will remain there, I live in an apartment complex and the vacuum is too noisy to use here. The claimant's settlement terms were rejected with the following explanation:

    " I would hope people check will fact check this clients claim to insure its accuracy. A simple Goggle search can clear up some of this bogus claim ! We also keep meticulous records of our sales and her old vacuum was disposed of as we said we would. It was NOT SOLD ! If we had it to give back to her we would have, but unfortunately our trash removal service had already picked it up by her return. The vacuum she dropped off was much louder than the one she purchased as would be any Kenmore that old. I ran other more expensive vacuums in the store that were louder than the one she brought back. The only vacuum we ran that was quieter than her new one was a Miele for much more money. I initially thought she had a lemon and that their was something wrong with her vac until I turned it on and it sounded perfectly normal as compared to any other vacuum in our store ! I immediately new something was up other than her initial complaint of a loud vacuum because it obviously was not loud ! I asked her what her real issue with the vac was ? She became irate and started accusing me of selling her old vacuum and lieing to her about a lot of diff things. All of which were untrue. As clearly marked on her receipt and posted in two locations, one at the register and one on the wall behind the register, ALL SALES ARE FINAL. I would also remind her that false statements made publicly expose her to civil liability . We are a very honest and honorable business that have done numerous repairs for free every month. We have repaired vacuums for customers for very little cost when their Vacuums have been misdiagnosed by other shops for motor replacement at hundreds of Dollars and we have repaired them less than $50.00 dollars and some times for free because they just needed to let their thermal motor protector cool down ! I am a Soldier and former Police Officer with an abundant amount of HONOR and Integrity , something this Country is lacking in greatly these days. I will not become part of the problem by backing down to Bullies for a good review by anyone ! I would hope that People Claim has the same integrity and Honor as my Store its employees and myself !"
