Statement of Claim
Claimant says:
"On September 18, 2012 my husband's hotel room at sleep inn & suites, 222 airtex boulevard, houston, tx, was robbed; the surveillance video clearly shows the hotel desk clerk giving my husband's room key to a person without checking for ID; the hotel clerk was working as an accomplice to the thief; my husband's laptop computer, software, briefcase, memory cards, laser pointers, wireless mouse (2) & portable scanner were stolen. the computer had our personal information on it as well as our business clients' information; the theft was reported to the harris county, texas police dept; preceinct # 4, case # HC 120128675; the hotel manager, Ashish Patel admitted to the police deputy that his hotel & his emplyee were negligent & caused my husband's rom to be robbed; the harris county police dept. has a copy of the surveillance video; the theft of our personal & business information on the computer necessitated the expenditure on our part of buying a LifeLock Identity theft protection insurance policy at the cost of $1200, plus the expense of buying new software, a new laptop computer, laser pointers & portable scanner. So far, the hotel owners have refused to reimburse us for our loss even though they have admitted to the police under oath that they were clearly negligent."

  • "Choice Hotels International, Inc. is a franchisor and does not own, operate, manage or control the day-to-day operations of any of its franchised locations. Please contact the owner of the Sleep Inn & Suites in Houston, Texas."

  • Has this hotel been charged with anything criminal? If they are admitting to liability and have given this statement to police, I would think that letting them know you will take them to small claims court would be enough to have them settle. Generally the dollar limit on small claims is $5,000. Perhaps letting them know that you are willing to settle for the amount above rather than the hassle of taking them to small claims court where you will seek the maximum will get them to pay restitution. I would also mention that you would like to resolve this quickly because I am sure they do not want negative attention called to their establishment (be careful how this is phrased because even though they may be 100% liable, veiled threats will get you nowhere). Also, find out how each hotel is managed. If it is individually owned, what if any, liability insurance is carried by the hotel itself to cover such theft? Additionally, is the corporation as a whole insured to cover claims? If you are not able to recover your losses at the local level, you may need to escalate the claim to the corporate level. I would caution you at each stage to remain calm and level headed (very difficult to do since I am sure this has been extremely difficult) and present all the information as you have here. Again, the hotel chain will hopefully want to avoid negative publicity and would be happy to settle the claim. Good luck!
