Statement of Claim
Claimant says:
"On March 20, 2014 I found a website "Az Trail Horse Company. I called Shane Wagoner and made an appointment to see a horse named" Marley" priced at 2800.00 on March 25, 2014. I lived in Willcox , Az at the time so my husband and I drove to A.J. to see the horse. I bought the horse, but Wagoner would not take a check, had to be cash only. Should have been my first clue. I gave him the money and signed a contract he had written stating that if the horse didn't fit me I could return it in 30 days, but no money would be refunded. The contract also stated the horse to be 7 or 8. He agreed to meet me in Globe with the horse on Friday the 28, but he didn't show up, so I drove on the A.J to get the horse. When we got back to Willcox I invited my neighbor, Natalie, a vet tech, over to see him. She commented on the appearance of a snotty nose, we figured it was due to the long ride home in the trailer. By Thursday 6 days later the horse was sick. I took him to the vet in Safford where she said he had pneumonia. She looked at his teeth and said this horse is well over 16 years of age. I paid the bill of 180.00 for the exam and antibiotics. We I got home I called Wagoner and told him the age of the horse and that I was bringing him," Marley" back. I also stated that since HE breached his own contract I wanted my money back. He refused, but stated in another contract that he would find me another horse within 6 months. I returned the horse on April 5, 2014. I called him several times, was very hard to get ahold of. On June 27, 2014 I got ahold of him and he said he didn't have a horse for me and that what I was looking for was hard to find and that HE WOULD CONSIDER GIVING ME MY MONEY BACK. That was the last conversation I had with him, after that he would not answer the phone or any of the messages. Oct. 5, 2014 was 6 months. I still have no horse or my money. On OCT 9, 2014 I left a message that we needed to talk and resolve this issue, I never heard from him. On Oct. 14, 2014 I filed a complaint with the BBB. On Nov.3, 2014 I received a letter from the BBB stating that they were unsuccessful in obtaining a response from Wagoner and had closed the complaint. This man needs to be held accountable for outright stealing my money. I have all documents pertinent to this complaint. Contracts, vet bill, statement from vet on actual age of horse and BBB letter."
