Statement of Claim
Claimant says:
"We had a contract with Qwest, they would furnish the internet we would pay the monthly fee. Every time we tried to use the internet a big block wold appear saying "Qwest is upgrading, try later". This would stay on there all day & night for two moths. We would call Qwest, they would tell us this process was almost over, it never did. We refused to pay them for a service they did not furnish. We feel they broke the contract by defaulting in providing service. They have put this on our credit report and we have been denied cedit due to this which is the only bad mark on our credit report. They had one of their technicians try and help us remove the block and that person ended up freezing our computer, causing us to lose very valuable records not to mention old family pictures we hadn't downloaded yet. I have copies of letters I wrote them explaning why we were't paying them, they weren't inerested."

  • You stated in your claim that this company has put on your credit report that you have not paid your contract (which you are disputing the service). Have they referred it to a collections agency at all? One of the rights you do have, in regards to your credit report, is to actually put a public rebuttal to that claim on your credit report. If they have referred this to a collections company, you can dispute the debt as you did not receive the service you paid for. I see from your attached exhibit that you also sent a copy to an attorney? If you are in consultation with an attorney, while small claims can take some time, here you paid for a service that you were not provided with, which also damaged your computer, and they are trying to state that you breached the contract by not paying. Perhaps an attorney may help you the best in this claim.
