Statement of Claim
Claimant says:
"When I called to order equipment I was instructed to purchase from their territorial distributor in Raleigh NC. I made arrangements and sent the check to the distributor as instructed. He misappropriated the money and the company says they will not ship my equipment. They say they are not responsible for the actions of the person they instructed me to buy from. I have tried to go to small claims court but the distributor can not be found to be served. His mailing address on the invoice and all his literature is a UPS Store mail drop."

  • There was far more issues involved which led me to think all was OK to make the check out to JC Placec first off Plotmaster had lost their manufacturer and by both Plotmaster and Placec a new mfg co was setting up. My machine would be in the 1st run per Placec 2nd run per someone @ Plotmaster According to Plotmaster my order was in and would be available June 1st My pmt had been made on May 16th and cashed on the 21st All 3 ladies I spoke with at Plotmaster had been made aware that I had paid Placec. It was not untill the 12th of June that I was told pmt had not been recieved. I was then also told that Placec was already in dented to Plotmaster and that he was on a cash basis. I had up untill this time been told by Placec I was to become a distributor for my area under him. Plotmaster told me after all had transpired I could still be a distributor directly to them They were in contact with me and Placec in a attempt to get pmt sent in. Promises and lies wereforthcomingfrom Placec for weeksbut never any money Placechadalsotold partof the truth in that shad to send partof the money in to get my equip theist back ordered. Because of all confusion of new mfg and delays and back orders and my becoming a distributor ; when Placec requested heck be made to him Ashe claimed to have already paid part of money to Plotmaster together neon back order list. We had no reason to suspect any wrong doing and being in contact with Plotmaster who gave no indication that anything was wrong we complied and sent check. There was no way for me to know about Plotmaster agreement with Placec or policy which they have since changed

The claimant's settlement terms were rejected with the following explanation:
  • "Mr. Braley with "all" due respect! You and I spoke for months, sometimes daily, about JC Placec. (who is an Independent Territory Reseller for NC/SC).. Plotmaster has made every attempt to help "YOU" collect the funds from Mr. Placec so we could ship your Plotmaster unit. Furthermore, I contacted you just a few days ago and gave you the name of the employer JC Placec was working for so that you could have the sheriff's department serve the papers for him to appear in court. Plotmaster has gone "Above and Beyond" to help you resolve the issue with Mr. Placec and it is not Plotmaster's fault that you made your check out directly to him and NOT to Plotmaster. In addition, "you" wrote your check out directly to JC and not to Plotmaster therefore we have no control and no means of recourse in collecting your funds. My sincere apologies again to you for your mistake but it is no secrete that Plotmaster's are shipped solely on prepayment up front to (Plotmaster) and not to the (ITR). The scam you fell for was orgistrated by JC Placec and NOT Plotmaster's!!!!!!!!!!!!!
    In conclusion your threats to ruin Plotmaster's reputation thru blogs, TV shows, magazines etc, is based upon you and your banker's making a bad financial decision and does not obligate Plotmaster to ship you product free of charge nor does it obligate Plotmaster since the check "was not" written to us directly.
    As I stated on your Facebook post calling Plotmaster "Crook's"
    IF YOU GO BUY A NEW FORD PICKUP... DO YOU MAKE YOUR CHECK OUT TO THE DEALERSHIP OR TO THE SALESMAN!!!??????????? MR. BRALEY IT WAS YOUR MISTAKE AND NOT PLOTMASTER'S AND WE HAVE SUPPLIED YOU WITH ALL THE MEANS WE CAN FOR YOUR LAWSUIT TO GO FORWARD BUT WHAT WE WILL NOT DO IS SHIP YOU A PLOTMASTER FOR FREE B/C OF YOUR MISTAKE.
