Statement of Claim
Claimant says:
"Hello, my name is Michelle Mayo. My husband, Philip and I was looking for a trailer to buy to put on state property due to my husband getting a transfer to Suwannee Correctional Institution. We went to Jerry Cortbetts and found a trailer we were interested in which the number on the trailer was TC-69. They advised us that if we put a deposit of $500 that will hold the trailer for us. We went to the bank and got the $500 that they required for the deposit. They wrote a receipt on 9/17/11 cash deposit on TC-69 2000 Skyline 16x76 3/2, the receipt states "Deposit Non-Refundable Upon Approval". They then said we were not qualified for the trailer so my husband told them that we would like our deposit back. Conveniently, Their accountant was not there but will be there on Tuesday. Come Monday they called us and told us they have a repo coming that we are qualified for. We went and checked it out and it wasn't what we wanted but could work with if we were qualified. They dragged through the mud for months. All this time, they led us to believe that we qualified for the trailer. Months passed and we still had no word whehter we were qualified or not. We then said that we would just like our deposit back. They would not give us our deposit back. I had called the lady that was taking the deposit, Treea, and she flat out said she is not giving us our money back because she worked too hard for us, which is what she gets paid for anyway. I then sent them a certified letter on 12/19/11 requesting our deposit back and I was giving them till 12/31/11 to no avail. They are saying we were approved but we did not meet all the criterias. If we didn't meet all the criterias, how could we be approved? They also wanted us to lie about our financial matters so we can meet all the criterias. These people are very dirty and shady and they take advantage of people like us who are new to the area. Please help us get our $500 deposit back."

Additional Communication Between Claimant and Jerry Corbettt's Affordable Mobile Home Sales Hide
  • Mar 26, 2012, Jerry Corbettt's Affordable Mobile Home Sales (responding party) added:
  • To Whom it may concern, The follow statement that was made about Jerry Corbett's Mobile Homes was false. Mr. & Mrs. Mayo came to Jerry Corbett's wanting to purchase a mobile. We worked with them because there credit was not the best in the world. We worked on their loan for several months. Mr. Mayo was approved for the loan. I told Mr. Mayo that he need to proof his income. Mr. Mayo came in two months after wards with a copy of his check stub. I sent it over to the bank then they declined the loan due to he has child support coming out of his check. Mr. Mayo filled out the application and on his application It asked at the bottom was he responsible for any other debt Child support or IRS and this was left blank. It also ask if you receive any other income beside your job. We can only use the infomation that the customer puts on their application. We had been back and forth on trying to find them a home that they could afford. I feel like they where approved and did not give us the correct information on there income. We worked several months for them and then Mrs Mayo called and threaten our company regarding her down payment. Our company tries to help everyone get a home. We can't help if he did not tell us everything about his debt. Our company policy is that if we get you approved for your loan that your deposit is non refundable. This also says it on the reciept that was given to them at the time that they put down their deposit for the home. We had also taken the home off the market for several months which this home could of been sold several times but we had a deposit on it as good faith while waiting for Mr. Mayo to bring proof of income. I am told the Mayo's that if he got his debt down or made more money with then a year if he comes back to our company that our company would give them credit back toward the downpayment of the purchase of there home. Our company wrote them a letter and never heard back from them sense. People today know how hard it is to get financed for a mobile home loan that has bad credit and I worked very hard to help them as I do to all of my customer but sometimes things don't work out and this is one of them applications that things where not fully up front with us to start with. If this was on the application we would of caught it before it was even turned in to the finance department. We also make sure that the debt to income is checked before we continue with the process and this situation we was not told the full truth on it from the start. I am sorry that the customer feels the way they do but from our stand point we lost several sales by holding this home for the Mayo's and still would be glad to work with them if they can get there debt down. I just want people to know that she stated that, that's what I get paid for is to work for her. I work on a commission base so maybe she needs to know how salespeople work. Salespeople do not work and get paid like people get paid that works for the State. I know that if you spent several months and hours and phone calls and listening to her cry that they need a house and you do everything in your power to help them and then it gets down to ordering contract to sign them out and failed to tell you that they have Child support to pay and it comes out of your check that would tell you that you truly don't make what you say you make with that coming straight out of your check that it would be less that payment then that's is your bring home not before your debt. I am sorry that it came to this but they have to understand when dealing with getting a loan everything about your debt and income has to be the full truth nothing kept disclosed. I hope in the future we can help them get a home.
